Even if they are not born in the UK they will be a dual-citizen from birth, because you and your spouse hold UK and US citizenships.

However, being born in the UK means they can automatically pass their UK citizenship down to their children even if those children are born abroad.

But if your children are born outside the UK they cannot pass down their UK citizenship to their children if those children are born abroad.

Interesting!!

They're born with dual citizenship. You have to let the US consulate know if their birth and they will have to file taxes in the US forever. Just like the rest of us!

LOL I have no sympathy for them! I had to do my taxes by hand this year as I was living in the US, but married to a 'nonresident alien' - was so frustrating.

Alternatively, if your children are born outside of the US, they will only be able to pass on US citizenship if they then live in the US for a certain period of time, part of which has to be after the age of 14 (or something to that effect). The joys of international families!

Curious...doesn't married filing separately take care of this issue?

Is there some reasoning behind this idea of paying taxes on citizenship rather than residency when the rest of the world does it the other way round?

So you can always feel Uncle Sam looming over your shoulder whispering "freedom"...

Or maybe that was just one of my hallucinations as I attempted to fill out my tax return.

I could be wrong on this, but I believe you have to file taxes but you get a tax exemption if you make under a certain amount.

I did do married filing separately, but because my husband doesn't have a social security number, I wasn't able to use online tax preparation. And with all of the visa stuff happening, I didn't want to fork over money to have someone do it for me.

I found this website on taxes that helped clarify things.

And the members on our tax forum are incredibly helpful if you have any specific questions.  :)  http://talk.uk-yankee.com/index.php?board=11.0

It has to do with people using off shore tax havens and the US wanting their cut of your earnings. Gotta love it.
The usual. American girl meets British guy. They fall into like, then into love. Then there was the big decision. The American traveled across the pond to join the Brit. And life was never the same again.

Same...I was able to prepare it online but not able to file online because my husband doesn't have a social security number.  Ugh.  Still waiting on my federal refund too.
