More Questions - FLR(M)
« on: June 07, 2017, 05:00:47 PM »
Hi all, I have a few more questions regarding my FLR(M).  Thank you in advance for all of the help as I know alot of these questions get redundant.
I initially tried to do the online application, and following the advice on here have decided to scrap that and do the paper application! That being said, the online version doesn't even seem like the same application!
Can I please confirm that I'm filling in the correct application, I came here as a married person on a spouse visa in December 2014, so I'm filling in the application FLR(M) version 04/2017.  Is that correct?
On the application, I have selected that I am:
Spouse or partner of a person present and settled in the UK and a biometric immigration
document.

Then:
2.2 Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave granted as a fiancĂ©(e) or proposed civil partner) with your current sponsor?  NO

I think I then select:
Second period of leave to remain (following initial grant of leave to remain as a partner of a settled person or person who is in the UK with refugee leave or humanitarian protection, or as a child of a person who has limited leave as the partner of a settled person).

Is that correct for my second application, but first from within UK?

Next, my husband has a son, born here, who is not my son.  I asked on here the other day to confirm that I do need to send his son's birth certificate, which I have.  However, I am unclear as to whether I also need to send his passport and/or copy of his passport?

Lastly, in reading here, I noticed some people mentioned filling in an Appendix.  In looking at recent checklists posted here, I saw no mention of that, so this is the first I've read of it!  It's not listed on the required document checklist, and when I search for the appendix, all that I find on the Home Office website is an old/outdated FLR(M) application.  Can someone please advise if this is something I need to add?

Thanks in advance!

Yes, that's correct. It's the only valid version :).

It is your second application in total, but first from within the UK... however, your answer to 2.3 is the wrong one - you have selected 'second application for leave to remain', but it's your first application for leave to remain (FLR(M)).

So, you answer as follows
2.1 Tick the first box
2.2 No
2.3 Tick the first box

The form has changed in the last few months and more documents are required now.

You will need to send:
- his birth certificate
- his passport
- documents showing where the child lives and that you/your spouse are involved in his upbringing

No, there is no Appendix - you only complete the FLR(M) paper application.

An Appendix is only required for the initial spousal visa applied for from outside the UK.

Wow, crazy about sending the child's passport now.  I can predict a lot of ex-parents NOT being willing to allow that to be sent.... ::)

Yeah, I checked out the older versions of the form.

The November 2016 version only requests the birth certificates, but the December 2016 and April 2017 versions have a whole section on the required documents for children now (both UK citizen children and those applying for a visa).

That was supposed to be ex-partners!  I like to think we don't have many ex-parents.   ;)

I just applied for my FLR (M) on Monday same day service.

My husband has a dependent son and we only needed his birth certificate. I included his passport number but no other documentation was needed for him.

I'm a bit nervous now.  I sent my husband's (UK citizen) son's (UK citizen) original birth certificate and full copy of passport.  He's 9.  I wrote that he is not my dependent or child, where he lives and that he stays with us approx. 3 nights per week in the child section.  I also noted that there is no court documented custody arrangement because my husband and the child's mother have amicably agreed and also noted that child support is shown on the bank statements.  I didn't include any other documentation...he's 9.  He doesn't have mail dated within 3 months and there's no other way to prove that he doesn't live with us??  So now I'm nervous they will reject because I didn't include all that other proof!

I think it will be fine. You included more information and documentation for your step son than I did for mine and mine was approved no problem.

I think that's exactly what you needed to do  :) For my step-kids I just send their birth certificates and answered all the questions. Hopefully your stepson's mother was understanding about needing to send in their birth certificates! It was a bit of a headache for me  ;)

Thanks nctami72 and brenzie!  It seems like the extra documentation is a new requirement, so hopefully it will all be fine.  I did feel a bit awkward asking my step-son's mother for his passport and birth certificate only because I felt like it might seem like I was trying to kidnap her kid!  My husband asked her for the documents first, and he just told her I needed them for my visa application, which if it had been me, I would have thought that was weird.  However, she didn't give us any trouble.

It is new but I don't think all of the documentation applies to the applicant when the child is not yours, only the birth certificate is needed.

The other documentation would be needed if the child was yours and in the UK.

I didn't need to supply any further documents for my dependent daughter  (age 17, not applying with me) other than her birth certificate.

And I applied after the new form was published.

Do you still have the email confirmation from when you booked biometrics? That would have the date on it.

Otherwise looking back at your previous posts on the forum may give some idea of date. If you can't find the exact date, then month and year should be fine.
