ILR questions - 5 year route
« on: August 03, 2017, 11:32:17 AM »
Hi there

I’m approaching ILR early next year on the 5-year partner route and I just want to clarify two things before I start thinking too much into it. I would like to sneak in before the fee change in April (!) hence why I’m thinking about this so early…

I entered on April 16th 2013 on my initial visa (received my FLR(m) in October 2015). So if I’m not mistaken, I can apply 28 days before the 5 year mark of when I initially entered? So this would be March 20th 2018? I hope I’m not mistaken here!

My other question, from what I understand for ILR I will have to list ALL of the days I’ve been out of the UK for whole 5 years, correct? (I remember with FLR I didn’t have to list any travel as it only asked for 6+ months, so I just want to make sure – this will take so much time to compile as I travel so frequently!)

Thank you so much in advance for any help!

1) yes, you can apply up to 28 days before April 16th 2018

2) No, the number of days is only for UK citizenship. What's important for ILR is that you have lived together for the whole 5 years

Ok awesome, I can get in before the fee change! Thanks.

Don't I have to list the travel dates on the application form though? I'm not worried about number of days outside the UK - more so just how many short weekend trips I'll have to think of!

Thanks again.

Hopefully!  In 2016 they snuck the increase in in March.  Sneaky bastards.

Agh really? I'm going to make my appointment for ASAP in March...like potentially on the first available day I'm allowed. I can't afford even more!

You'll likely be fine.  But do know they can be sneaky!

If you are doing in person, you pay when you book which can be 42 days before the appointment and you pay the fee as of the day you paid (not the appointment date).

I get to book on Monday!  It's £590 extra for in person and £75 extra for some more desireable time slots!

Oh I had no idea of this! Ok great, I should be ok then as long as I can pay early enough :) I've always budgeted the extra for same-day, because I just can't handle the wait of not knowing.

Good luck with yours! I'm envious, I just want to get mine over with!

In regards to you being out of the UK, you do have to list absences from the UK, but they won't affect the applications unless you've been gone for several months at a time.

There are only a couple of spaces to list them though.

So... if my entry on a marriage visa was February 1, 2013, and my first FLR (M) was June 5, 2013 (that was my in-person appointment date), I go with 5 years from June 5, 2013, as my 5-year start date, right?  So i can apply up to 28 days before 5 June, 2018... May 9th, or thereabouts.  And I can book an in-pwrson appointment up to 42 days before that... so it is possible that I could pay before the fee increase, too (assuming it's not early again).  That means instead of paying the fee increase, I could pay for in-person instead, and it wouldn't cost too much more that a slow application after the anticipated fee increase.  Yes?
9/1/2013 - "fiancée" (marriage) visa issued
4/6/2013 - married (certificate issued same-day)
5/6/2013 - FLR(M)#1 in person -- approved!
8/1/2016 - FLR(M)#2 by post -- approved!
8/5/2018 - ILR in person -- approved!
22/11/2018 - Citizenship (online, with NDRS+JCAP) -- approved!
14/12/2018 - I became a British citizen.  :)

This little nugget of information is the reason I obsessively read all the topics every day!  Thanks for this!  I will tell my husband that we might have to book a day off (or pay for a Saturday appointment).  I would much prefer in-person if we can swing it.  And this could be the thing that makes it work.  Yay!

The new SET(M) is really badly formatted.

So that's how they got it to be 20 pages less than the FLR(M) application!

Pretty much, because there seem to be very little difference in the questions!

As far as I could tell, the only significant difference is the LiUK, the minimum time in the UK to be eligible, and the lack of IHS.  Yes?
