I agree with Larabee.  There have been a couple of applications I thought would be refusals this summer and they were approved.  I firmly believe you aren't out until you get a letter.

Yes, it could be a refusal (and I'd recommend you lightly thinking that way, don't dwell).  Yes, you may lose a bit more time and money.  But you don't know that you would be gaining anything by withdrawing.

If you want to do something, I'd recommend having your husband press his MP to call UKVI and find out why they've set your application aside.  That would be a great opportunity to possibly get the correct paperwork as well (possibly).  Again, speculation.

Have him try to set up a face to face appointment with his MP, if possible.  Otherwise a phone call.

Because at this point, if I get refused, I want to be ready to go back in in under 72 hours, biometrics permitting!

This time we will absolutely go in using category B, earnings. My husband's earnings from the last four months will cover the majority of the required amount. That said, do I only need to provide payslips that indicate the amount has been met, or do I need to provide them (along with a letter of authenticity from his employers) for the full year prior to the application?

Using the earnings category, do I also need to provide bank statements?
This is the bit that tripped us up first round, I think, so I want to be sure to get it right.

For Category B you must include ALL of the following:

- 12 full months of original payslips showing total earnings of £18,600 before tax during the 12 months
- 12 full months of corresponding bank statements showing the deposit of every single payslip into an account in your husband's name
- a letter from his employer stating ALL of the following:
(i) the person’s employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

Optional but recommended:
- his original job contract
- his latest P60

What's a P60?

It's like a W2... it details all his earnings and tax paid during the previous tax year. The P60 is issued in April each year and covers the April 6th - April 5th tax year... so his latest one will be from April 2017.

Fair enough :). For the payslips and bank statements, if he hasn't worked for the entire 12 months, you just provide the payslips he does have... but you still need to provide all 12 months of bank statements.

Just to confirm though, that he will definitely meet the £18,600 requirement at time of application, if you do need to reapply?

You said the majority of the requirement will be met by his employment since July - but what about the rest of it?

Rest of it comes from his employment at Virginia Tech prior to our move. It's just that if I reapply, say, November 1, then 12 months of payslips includes both his time at VT and his time at Williams. The job at Williams may actually cover all of it, but I don't know if we'll be allowed to count the relocation assistance lump sum reimbursement they gave him. It came through as a payslip like any other, but I figured I'd play it safe and not count it.

I.AM.AN.IDIOT.

I have been all freaked out about the financial requirement, and I just realized that its pre-tax income. That means we meet it for our original application, and I"m back to having no clue why they're screwing around with my application!

Hey, my sister finished her undergrad and PhD at Virginia Tech . I know it's a big school but don't come across many from there!

I *really* hope they count all of your income and documents and you finally get a positive decision. It's beyond cruel for them to hold onto your passport this long when you could easily reapply!
