How to submit a dependent visa application with a parents
« on: October 07, 2017, 04:08:58 AM »
Hi there, I will be submitting mine and my son's applications in the next couple of weeks. These are to join my husband, his step father in the UK. I realize I can't submit more than one set of original paperwork and I believe that should be with mine. But do I need to submit two copies for his? Do I make a note on his application that original documents are with my application? I do have full parental responsibility, (custody) of my son and I have the court order stating he is to live with me full time and so forth. I just want to make sure I submit it all correctly to avoid any issues with his application. I also planned to submit the parenting plan which states I will be moving, which the judge signed off on. Oh and the custody orders talk about me bringing him back here for visitation.
I guess one more question... is there a specific order that the paperwork should be in when I send it in? Thanks so much for your help!

Just have the two applications and appendix on top of the supporting documents.  They'll know they all go for both applications.

No specific order, just do what feels logical and place them in a neat pile.

Thanks so much! One last question, for now,   ::) When I'm submitting the applications online, I have two applications, one for my son and one for myself. Will I pay together or separately?  Will I be able to schedule the biometrics for the same time or...? I realize these may seem like oddly specific questions, I'm just trying to make sure I don't hit any surprises. Also, any idea how long it generally takes to get the biometrics appointments? If I submit on a Friday, will I get able to schedule for the following Monday or Tuesday do you know? I realize you don't know for sure, just wondering what has been people's experiences.  Thanks so very much!

Sorry... One more... Does the high court decision regarding child applicants  still hold true? Will our application go on hold because I'm bringing my son? I have full custody of him and full responsibility for him. I am planning on submitting the court order as well. Thanks!!!!

It only applies to those who did not meet the financial requirement.

We got our application for the dependant refused because our lawyer asked for a visitors visa.
It's the same visa application and documents as the fiancé visa but instead of selecting 'Settlement -> Marriage' you select 'Settlement -> Child Dependant of a UK citizen'... so the UK citizen is the sponsor for both visas.

Your situation is now a little unusual because normally the fiancé and child dependant visas are submitted together and only 1 set of supporting documents is supplied for both visas. So I think you will need to include a letter explaining the situation and that the child dependant visa should have been submitted alongside the fiancé visa.

I assume that as you have also applied for the fiancé visa you will need to show annual income of £22,400 per year (fiancé plus 1 child)... whereas if it was just the fiancé needing a visa OR just a child with no fiancé/spouse in the picture, it would be £18,600.

You also need to print and fill out Appendix 2, same as before.

We did photo copy two sets of information but the people on the forum are far more up to speed with the process. I hope this helps and I’m confident that you’ll be fine.

It wasn't quite as simple as your lawyer 'asking' for a visitor visa as part of the dependant visa application. You never even applied for a dependant visa in the first place.

Your lawyer:
- applied for the completely wrong visa type for your daughter
- which cost £1,300 less than it should have (did you not question why you were paying so little for her visa?)
- sent her visitor visa application to the wrong consulate for processing, in the wrong country... visitor visas are processed in New York
- has now cost you unnecessary time and money, because you have to go through the whole application process again now

If I were you, I would be extremely angry with the lawyer and would make a formal complaint - they have messed with your lives and have made things more complicated for you.

Thanks so much for responding! So when I click submit on each individual application, do I pay separately? Schedule the biometrics separately? If so, is it likely I will be able to get the appointments at the same time? Thanks again!

You have to complete and submit two separate online applications - one for you and then one for the child. You pay for them separately and schedule biometrics separately.

For your visa, you select: Settlement -> Settlement -> Wife
For your son's visa, you select Settlement -> Settlement -> Child Dependant

You can try for appointments around the same time... though a lot of people have had luck with a walk-in appointment a few days before their actual appointment, so you probably would be able to get them done at the same time if you both showed up together.

For your visa, you will have to pay the IHS surcharge of £600 when you submit the application. You are supposed to do the same for your son's visa too, but there seems to be a glitch in the IHS payment system where it says there is no charge for children... which is not true. If this happens, you'll just need to submit the documents without paying it and then wait for UKVI to contact you asking for the payment.

Thank you SO much! Its so stressful and all these random detailed questions pop into my head and I just start fixating on them! We have such a short time frame to get all the docs in to Sheffield before his pay slips hit that 28 day mark. To top it off we won't have his most recent full bank statement because if we wait his pay slip would fall out of those 28 days, So we are submitting 6 months back PLUS this months partial statement that the bank is sending with their stamp on it. So they will have 7 total deposits shown from his work, he is military so he gets paid monthly.  I'm just hoping I can get a biometrics appointment for us with in a couple of days so I can get the packet to Sheffield before we hit that 28 day mark. It is cutting it so close! Between, selling my house, moving in with my mom and applying, I'm going to be out of my mind by the time it's all said and done! Thanks so very much for your help!

The payslips and bank statements only have to be dated within 28 days of the online application date, not the date they arrive in Sheffield.

So you just have to make sure you submit the online application within those 28 days.

Angry isn’t the word!! We paid £1464 (or so) twice so assumed there was no underspend, she did say both applications were less than she thought but never said how much.  We are now applying for our daughters.  I know you’ve stated before but is the choice of ‘dependant child of a settled person’ correct to choose? Just checking our online application now to make sure it’s correct - do we now also need to pay the £500 surcharge?

I hope you got that £1,300 or so back from her... you gave her £2,928 and she applied for one visa worth £1,464 and one worth £89... thereby fleecing you out of £1,375.

The total cost for both visas plus IHS surcharge should have been:
(£1,464 + £600) x 2 = £4,128

But your lawyer would have paid just
£1,464 + £600 + £89 = £2,153

Once piece of advice for future applicants:

ALWAYS fill out and pay for your own application. DO NOT let a lawyer do it for you!

Personally, I would want to double-check and research it all myself (probably the scientist in me)... so I wouldn't trust anyone else to do it for me .

Yes, that's the correct type.

It's £600 surcharge for this visa. You should have to pay it but there has been a glitch in the IHS system whereby it says child dependants don't have to pay it, and it won't let you do it.

So you will probably have to send off the application without paying and then wait for UKVI to contact you and ask you to pay it (usually right before the decision is made).

They had the money in the client account, they have to return it, having now looked at the application form I cannot see how you could get it wrong once selecting settlement!! She is paying for the wasted, £89 and the priority service, but it’s not about the money it’s the time wasted waiting in excess of 60 business days, she then tried to justify/explain the visa choice....my blood boils every time I think of it.. two steps forwards and 6 back... the Ihs surcharge isn’t applicable for a fiancé visa but is for the dependant.  As we look back all the warning signs popped up.  The cost of the solicitor fees was a gift, which turned out to be a box of poisonous snakes and scorpions. Smh.  Anyway fingers crossed for a straightforward submission.
