Guys! excuse my excitement but I received an email "ready for collection" !!!! after 26 working day!

"Dear Applicant,
Your passport and supporting documentation are now ready for collection at the TLScontact UK Visa Application Centre. You can collect your documents in person or by a representative."

We cant really wait till tomorrow to go and collect it! Does this mean we got it this time???

Fingers crossed for you!! I'm not sure of the emails outside the US, we aren't told til we open our package, but I sure hope so :)

Hi Everyone

So I’m seeing a lot of approvals coming through of applications made around the same time as us (yay!) but now I am a bit worried that we have not received a decision and my mind is working overtime!

We do have a couple of complicating factors, being that my husband was refused a previous spouse visa due to being in-country and I was unable to provide company bank statements for the full 12 months because while my company was set up in Dec 16, I did not have my bank account set up until the end of Feb 17.  So I only provided company bank statements from Mar 17 to Dec 17.  Prior to that I was operating through an umbrella company and had a salary paid into my personal bank account.  I provided payslips from the umbrella company from Dec 16 to Feb 17 and personal bank statements from Dec 16 to Dec 17. 

We explained all of this in our initial application but UKVI still asked for the company bank statements from Dec 16 to Feb 17 and we responded on Friday 26 Jan 18 by providing letters from my company bank confirming when I opened the account.  We requested that the UKVI exercise evidentiary discretion on the basis that I comfortably meet the financial requirement based on either: (i) salary and dividends between Mar 17 to Dec 17 which can be shown from my company’s annual accounts and my company tax return which has been filed with HMRC; or (ii) salary from Dec 16 to Dec 17. 

We provided all other docs required under Category F with our initial application and we meet all other requirements.  I also have a daughter (who is a British citizen) who my husband has been step-father to since August 2014 and we have made submissions on grounds of Art 8 ECHR (i.e. best interests of the child).

Does anyone have any idea whether, in these circumstances, the UKVI could (or would) refuse our application solely on the grounds of the fact that company bank statements between Dec 16 and Feb 17 do not exist?  Technically, we have provided all company bank statements that exist for the period Dec 16 to Dec 17.

Any thoughts welcome!

Kamlaw7 , our hearts go to you! i am sure you will get a yes too! I noticed all priority applications made in the middle of December are now answered.

Do not focus too much on this ( i know its nigh impossible!) but go about your day to day things, meet friend and family more often, focus on things that shift your mind away from this frustrating waiting time.

Tomorrow my wife will go and collect her passport, and I really pray the universe this time we got it. Our first application was refused due to the absence of "letter from employer" and "payslips saying paid by cheque "  but bank statements saying "paid by bank transfer" instead of asking for clarification they carelessly refuse and disrupt people's lives!

If your lawyer is requesting that you be approved outside the rules, the application could take an exceptionally long time to decide, I'm afraid.

Thanks for your quick response.  On what basis do you think we are asking to be approved outside of the rules?  Friday will be 6 weeks since Sheffield received our docs.  That already seems like quite a long time for a priority application...

You said that you were asking to be considered under Article 8 ECHR... that's outside the rules.

Article 8 is only considered where the financial requirement cannot be met and instead of automatically refusing the visa, they look at the best interests of the child under Article 8.

If the visa is granted under Article 8, you will be put on the 'outside the rules' 10-year path to ILR, which mean an initial spousal visa followed by three FLR(M) 2.5-year visas (at potentially £3,250 or more per visa) until you can apply for ILR after 10 years in the UK... instead of just one FLR(M) and ILR after 5 years if you meet the financial requirement and they don't have to consider Article 8.

Outside the rules applications can take several months to be decided.

My wife only got one email which said,

A signature will be required to complete delivery, and your package can be tracked using the links below for UPS.

Please be advised that some shipments may be subject to delays beyond our control due to Customs inspections.

UK Decision Making Centre

Nothing is mentioned about a decision being made and we have not received the other email the first makes mention to.

I have checked the tracking number and the parcel is in Philly, so I'm assuming they may have forgotten to send us another email.

Any info from those who have received decision emails would be appreciated.

For both applications inside the UK, I received two emails at almost the same time. One said a decision had been made plus some boilerplate stuff and the second listed the tracking number, etc. One of those applications was a refusal; the other one we got the visa.

So, I would imagine it's just an oversight and you shouldn't read into it. The package is clearly on the way!

You said you asked that UKVI exercises discretion and that you asked for the application to be considered under Article 8.  Both of those are outside the rules, which are tough applications to get approved.  I was using your words.  :)

I'll keep you posted tomorrow everyone! please pray for us! i hope this 4 month-long-nightmare will end tomorrow... Let us pray for all couples who are separated because of this political games and ugly laws! Hope all of them will be reunited soon....
