So BD 61 and we have received an update as to the reason for the delay in our case from The Army Families Federation FCO Advisory team who made an enquiry on our behalf to the Home Office.
And i quote.

“ I have had this from the Home Office.”
 
“We are still waiting for some policy advice on the assessment of the child’s application, I have asked for this to be chased up today and will advise you as and when we are able to move this forward.”

Any thoughts on this? As most will know we submitted with the application all court ‘custody’ paperwork etc accompanied with court approved parenting plan clearly noting the intention to relocate to the UK with Bio Fathers signed acknowledgement of such. And crucially no further documentation has ever been asked for.

What we’ve come up with is this, that as we applied under Appendix Armed Forces which carries a 5 year visa as opposed to the standard 33 month one, that maybe this could be the isssue given the child is 15 1/2 yo. Which would take him past the 18 years old mark and would then need to qualify in his own right or something?

I assume they would not just refuse due to the child’s age!!

As always any thoughts most welcome!!

Well, we were right in that it's something to do with the minor child.

And it's good that you have had this confirmation, it'll likely jump start a decision... they can't sit on it for ever.  :)

Fantastic news.

Here's how I read it:

"The Entry Clearance Officer does not have the level of authority needed to approve a child dependent visa.  This has been escalated to a different team who have their thumbs up their bums.  Eventually they will read what you have provided and the visa will be granted.  I'm not sure how much longer this will take, unfortunately."

This has NOTHING to do with this being an armed forces application.  It has everything to do with extra controls being put around dependent applications to ensure the documentation crosses all the t's and dots all the i's (something must have happened to cause extra scrutiny for applications with dependents).  The child's age will have no bearing.

You guys are almost there.  I can feel it!

They need to complete the online application and appendix 2 but there is a lot more to it than just filling out the forms. Perhaps your friend would like to join the forum? :)
