We definitely meet the requirements and our evidence is extensive and comprehensive, but it's at the ECO's discretion and I've seen rejections on this forum and others for daft reasons.

What encourages me somewhat is that lately it appears Sheffield is asking for clarification or missing evidence before rejecting. But I fear that commendable policy could now slip as they hit peak business.


What daft reasons have you seen?

The only refusal reasons I have seen on this forum are for:
- missing documents
- documents in the wrong format
- not meeting the requirements

All of which are valid reasons for refusal.

As mentioned, it’s a tick-box visa. If you tick the boxes, you get the visa. ECOs aren’t allowed to refuse or approve based on personal feelings.

We met and got engaged in Spring 2016.

We married in the US in May 2018 -- after several meet ups and speaking every day.

However my wife's first trip to visit me in the UK in Aug 2016 failed -- because she was refused entry citing insufficient evidence of ties to the US. We were open and honest and told Border Force we were engaged. At least they can see from this that we had a relationship back then!

After two failed attempts we finally got a visit visa in 2017. Not easy to prove intention to return home when you're openly also planning a life in the UK and already shutting down the old life in the US!!! That successful application was a huge task for us.

She visited me on the visit visa for 2 weeks in November -- accidentally arriving a week before the visa start date! And was let in.

She then visited me on the visit visa for 5 months from Xmas.

On the plus side we had 6 months of contact to help us be genuine and subsisting. On the downside they might not like her staying so long.

Also it's difficult to think of everything and easy to overlook potential discrepancies and technicalities. E.g. One thing I just thought of is that our rental property particulars do not not give measurements of the rooms, just photos of each room!

That's not required. All you need to do is show the property won't be overcrowded (# of rooms) and have permission to reside there. :)

The best I could get was an email from the letting agent who manages the property saying my wife could in principle be added to the tenancy agreement subject to right to rent and credit checks. An ECO could argue that this is not guaranteed e.g. because the outcome of the credit check is not yet known. Lots of potential grey areas and pitfalls like this which terrify me.

No immigrant can be added to a tenancy agreement until they have a BRP so that is why they worded it that way. It's not really subjective, it's UK law.

There is no credit check requirement.

In my 11.5 years on the forum I have never heard of an ECO doing a credit check.

There is no credit check requirement.

Since the immigrant cannot be added to the tenancy agreement until after the visa is granted, the ECO merely needs proof that you have permission to live there by the landlord and that the space has enough room for the tenant/immigrant(s) moving in.

Credit checks/applications to rent/ all come after the visa's approval, and by then you have it in your hand. The ECO just wants to know that you have the permission, what happens after is, frankly, the immigrant's problem. But honestly, if the UK sponsor's landlord knows the immigrant is coming and approves the situation enough to write a letter for the application, there really shouldn't be an issue.
