I didn't have enough documentation stating that I had custody of my daughter. I was never married to her father and under TN state law, I had all custody rights by default etc. I have NEVER needed proof of that. Not even to get her passport. He's just never been present in her life and I had school records and dr records etc that stated as such as well as the recognized law of the state. UKVI said it wasn't good enough. That I needed actual proof of custody.
So I had to gather up the funds and spent almost exactly a year taking the stuff to juvenile court and getting a default judgement stating that I am her sole caretaker and custodian and the only person with physical and legal custody over her and per the court, she has permission to obtain a visa to reside with me in the UK. I've been here since October last year, and have been back to TN twice and she's been over here to see me once since then (let me tell you, trying to get a kid over here for a visit after having a visa refusal is ABSOLUTE BOLLOCKS....that's another story lol).
So, I'm personally not bothered about whenever UKVI decides to get their sh*t together and actually return her documents etc. I'm satisfied with knowing that she's approved and I'll deal with whatever lax issues that arise from UKVI not pulling their finger out and get the stuff sent.
For the record, I effing HATE this process. I hate the lack of communication or the deliberate miscommunication by the 'customer service' (my happy ass, that's not customer service AT ALL). I think not getting any of your money refunded after a refusal is an outright scam by the government and the system is seriously screwed up. Last year, when I got our ppw back, there was absolutely NOTHING regarding my daughter, you're supposed to receive a letter in your packet on whether you're approved or not and there wasn't anything about her so I spent about 3 days trying to find out if she was approved and they forgot her vignette (it's happened) or whether she was denied and why. Our MP was able to get a response ASAP and forwarded a copy of the refusal letter to me via email. Guess how long it took UKVI to send me the refusal letter? 3 months.
I understand how upsetting this entire thing is and how unfair it is. I wish it was more clear cut. I'm just grateful to have applied from America instead of what the UK considers a 'suspect' country. I can't imagine that.
