Hi All!!!

I haven’t been on this forum very much since I applied, received my spousal visa and moved to the UK in April 2015. Now that my visa is due to expire 27/12/17 I been reading through other posts trying to prepare.  However, I do have some initial questions.

Section 2.1 I am applying as a spouse of a person present and settled in the UK (he is a UK citizen)
Section 2.2 Is this the first time you have applied for a visa or extension of stay in one of the above categories with your current sponsor?  Answer is No
Section 2.3  This is where I get a bit confused on the wording.  I think I should check the one that says:  First period of leave to remain (following an initial period of entry clearance as a partner of a settled person, …..)  Is this the correct option?

Section 7
We both make over the minimum financial requirement so I figured I would just use my income.  We will be filing under the income from salaried employment category A.

First question for 7.3A is, since I am using my income do I still fill out the Your sponsor column with his information?

7.3A (iii) Have you/your spouse been in employment with the same employer and earning the amount specified in (xiv) below continuously for 6 months prior to the date of the application?  The situation is I have been employed with the same employer for 21 months earning above the minimum income, but in the last month I have received a pay rise.  So now I’m not sure how to answer this question?

I realised that my payslips look like I could have printed them off myself, even though I don’t have access to do so, should I have my employer write a letter stating that they are original?  I am going to have my employer write a letter for me verifying my employment, what needs to be included in the letter?

Sorry this has gotten so long.  One last question, at least for now, my visa is a sticker in my passport, therefore I am correct that I answer no I was not issued a Biometric residence permit?

Welcome back :).

For 2.1, correct - tick the first box

For 2.2, correct, it’s No (because you have a spousal visa already)

For 2.3, you’re right - it’s first period of leave to remain (because your first visa was leave to enter, not remain)

For section 7.3A, you can just leave his employment blank and only fill out yours

For 7.3A iii) you need to tick yes, because otherwise you are saying that you don’t qualify under Category A and will need to use Category B instead... which is not true.

Were your payslips printed by your employer and physically given to you by them? If so. You don’t need a letter confirming them... but since you need an employer letter anyway, they might want to add in that the payslips were officially issued by them.

The employer letter must be dated within 28 days of your application date and must state all of the following:
- your employment and current salary
- length of employment
- length of time earning current salary (and also the previous salary to show it was also above £18,600)
- the type of employment (permanent, temporary, full or part time etc.)

Yes, it’s correct that you were not issued a BRP but you do bee to fill in the details about where and when you gave biometrics in the US and where your visa was processed.

Just to note that if you arrived in the UK in April 2015, you can actually apply for your FLR(M) at any time from 28 days before you reached 30 months in the UK (so sometime in September 2017) up to 27th December 2017.

I have always been confused as to when I could apply for my FLR(M), so I just figured I would be safe if I did it the first of December.

I'm sure I will have more questions in the near future.

Another question I'm not sure how to answer. 

9.15 Give details of the British diplomatic post(s) involved if the application was or were made abroad.

Is this the Sheffield office where I sent my first application?

Yes, it’s the address of UKVI Sheffield.

9.13 - date of biometrics in the US
9.14 - address of the USCIS Center where you gave biometrics
9.15 - address of the UKVI consulate that issued your visa

I think I have the application sorted now with that information.  Now to wait until I receive a few more items of correspondence from this month and get my letter from my employer.  Then I will be back with a list of the documents we are submitting for a final check.

Good evening all.

I was just reading through some other posts and realised that I never changed my address when we moved into a rental after I moved here.  The address that the home office has is my in-laws.   ;)  As I stated previously I am hoping to send in my application the first weekend of December.  Should I change my address now before I send in my application or just send in my application which has my current address?

Sorry, I didn't answer before because I really didn't know what to advise.

I'd say it's up to you. Since you're only a couple of weeks away from applying, it may not be worth changing your address, since your new visa will have the new address on it anyway.

But, if you feel better about doing it, then go ahead... you just fill out a form and send it off:

A few more questions as the time gets closer to putting my application in the post, and my stress level rises a bit.

I see people include a cover letter with there application.  What should be included in this cover letter?

I have put our home address on the application.  Now I am wondering when documents and approved visa is returned, will they have to be signed for?  We are both at work all day and wouldn't be home to sign for any packages.  How do other people handle this?

Yes, the BRP and usually the supporting documents are sent signed for.  Separately at that.

You just rearrange delivery to a time that is convenient for you, as you would with any package.

You don't really need a cover letter for FLR(M).

Some people include one if there's something in particular they need to explain (such as why they can't include all the required documents or to explain an unusual living situation), but otherwise there's not really any need to send one.

Your list looks pretty good to me.

If you are applying by post I would also include a photo of the two of you together as part of your relationship documents.

Financial

For the bank statements, DON'T send more than you need unless you have no choice.

They will only look at the ones covered by the same period as your payslips, which MUST cover a full 6 months.

At the moment, you have 7 months of bank statements but only 5 months of payslips (unless you meant 30th May, not 30th June?)... which means you will NOT meet the financial requirement with them because you aren't sending the required 6 months of payslips.

You need both your payslips and your bank statements to cover the entire period of 30th May - 30th November.
