One thing that is confusing me is regarding my job history when applying for the UK spousal visa. From October 2016 to September 2017 (11 months) I was working in Job A. I then left Job A for Job B in September 2017, and have been working there for coming up to 5 months.
I was under the impression that I had to have been in my current job for 6 months before I can apply for the Spousal Visa, but would my 12 month work history, with earnings between the 2 jobs above 18,600 be enough to apply now?
If you are currently still in the US and have a job offer for the UK, there are two ways to meet the requirement using your income:
Category A: if you have been with your current employer, earning £18,600 or more, for at least 6 months, and you have a job offer in the UK starting within 3 months of moving
AND
Category B: if you have been with your current employer for LESS THAN 6 months, or you have recently left your job in preparation for moving, AND you have a job offer in the UK starting within 3 months
So, I assume you will be able to qualify under Category B, for which you need to show:
1) you have a UK job offer paying at least £18,600 and starting within 3 months
AND
2) you have earned at least £18,600 before tax in total in the US in the last 12 months (from any and all jobs)
For this category, you provide as evidence:
- your UK job offer letter and/or signed job contract
AND
- 12 full months of US payslips from all jobs held
- 12 full months of US bank statements showing the deposit of each payslip
