P60 Question (For Spouse Visa)

Hey everyone! I hope that someone can give me advice to the below query:

First, here's a backstory... my fiance and I will be getting married in May. After our ceremony, we're going to send the spouse visa application + documents etc. to Sheffield to apply for the spouse visa.

My fiance emailed someone in the payroll department at his work to ask when the latest P60 would be available. Basically, the person in payroll told him that it's supposed to be available online by May 30. If the employer cannot provide the latest P60 in time, do we give them the old P60 even though the old P60 would not show the required sponsor income amount?

He intends to get a letter from his employer and bank slips showing proof of his current pay, which exceeds the requirement to be a sponsor.

Question 1: Is it essential to include the latest P60 if the employer doesn't have it ready by the time we apply for our application?

Question 2: If he can't supply his latest P60, then would the old one suffice even though it shows an amount that isn't true to his current pay (that would be lower than the financial requirements to sponsor)?

Question 3: If he contacted the HR department and got them to write a cover letter stating that they were unable to provide him with his latest P60... would this help?

I don't want our visa to be refused on this basis. Would it be likely for the visa officer to contact him for his current P60?

No, it's not essential to include a P60 at all.

The P60 is not a required document, so it doesn't really matter if you send it or not.

We recommend including the latest one you have, because it says in the guidance that they may ask for it, but depending on the timing of the application, it may be too old to actually show any of the income you are using for the visa.

So, I would include whichever one you have available on the date of application. If it's the April 2018 one, great... but if not, just include the April 2017 one instead.

Yes - see above. You're only including one in case Sheffield decide they want to see a P60. There's no requirement for it to show the same income that you are relying on.

Not necessary. Either include the old one, or don't include one at all. No explanation needed.

Pretty unlikely (can't remember anyone being asked for it before) and it won't affect the visa outcome, because it's not a required document.

You'd only be sending it as an optional 'just in case' document.

I have another question that's open for anyone to answer... Maybe y'all have thought about this before as well:

Would it be likely that the £18,600 financial requirement would increase any time soon (e.g. within the next few months)? I just don't want us to apply for the visa in May, and then find out that the required income has increased... If this sort of thing does increase, what amount (in pounds) does it increase by?

It was introduced at £18,600 in July 2012 and hasn't changed since. I have no idea if it's likely to change in the future, but at the moment, it seems to be staying where it is.

There have been a couple of High Court appeals filed claiming that the £18,600 is too high and that it should be lowered, but all of the appeals have been rejected and the £18,600 has been upheld.

I would assume that if they are going to change the income requirement, it will be announced several months in advance (the 2012 immigration changes were announced a couple of years before they came into effect).

It's almost 100% that the financial requirement won't go up in the next few months. The application fee on the other hand, almost definitely will go up. This usually happens at the beginning of April.

There's no requirement for the employment contract OR P60. And even though there's no "formal" requirement, should we still mention why we don't have either documents in a cover letter?

*Latest P60 won't be available upon application submission

I wouldn’t even make mention of the P60,they know the latest one will not be available because the tax year doesn’t close until April (the P60 is the U.K. equivalent of the W2)

I would mention the contact though, are you sending a copy instead?
