Speeding Ticket
« on: February 03, 2018, 04:51:39 PM »
I feel bad asking more questions, but this application has me so stressed out I can't think clearly!

The general advice is to disclose everything in the application. I got a speeding ticket about 6 months ago, does this go in 10.3:

"Have you or any dependents who are applying with you been subject to, or received, any other penalty in relation to a criminal offense; for example caution, reprimand, warning, or similar penalties in the UK or any other country?"

I realize 10.1 specifically says NOT to include speeding or parking tickets, but once you answer NO to that, it says to go to 10.3 which does not explicitly exclude speeding and parking tickets.

Also, I just read an old thread that said I can't get ILR until 5 years after a speeding ticket, is that true??

Thanks again!

Don't feel bad for asking questions. It gives us a chance to look things up. :)

Yes, it's always best to declare everything as deception carries a 10 year ban to the UK and now a 10 years ban from the UK too under the latest changes: likely brought in for Brexit, but it will affect those who entered using UK immigration laws too. Using deception on any visa can cause the removal of citizenship too, even if the visa the deception was used on didn't form part of their citizenship application.

As you can see, the UK takes deception seriously, which is why it is best to avoid being accused of it. Just make sure this is mentioned on every application you make and don't assume they already know: they do, but are looking to see if you are using deception.

I don't know where on the form you will put your speeding ticket. Perhaps ksands, KFDancer or larrabee might know?

I didn't know that.

From putting your visa route details in this link

Apply to settle in the UK

Find out if you can apply for settlement (also called ‘indefinite leave to remain’) in the UK.

https://www.gov.uk/settle-in-the-uk

It links to other guides, such as this one below-

The Home Office staff guide for General Grounds for Refusal under the Immigration laws. Updated on 18 January 2018 to take in the latest immigration changes.
https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/673998/GGFR-Section-1-v29.0-EXT.PDF

You can use that to see what is and what isn't accepted under the present laws.

The Immigration laws stop at ILR and if you want to apply for citizenship once you have ILR, then you use the Nationality laws. This is the present guide for Good Character-

This guidance tells Home Office staff how to assess the good character requirement in relevant nationality applications.

It applies to all decisions taken on or after 11 December 2014.
