Small update here. My fiancee is a bit of a worrier and went to see an immigration lawyer in the US to critique the plan of marrying over there and applying for the UK spousal... just in case. He said that marrying in the US on a visitor visa could be immigration fraud if we ever decide to move back, and I probably wouldn't be able to get my US visa/gc. Does anyone have experience with that? This wouldn't be for 5-10 years into the future (if at all), but it's a possibility.

Based on this, maybe a fiancee visa is the way to go, given there's a chance we might want to move back over there in the future.

It's only immigration fraud if you enter on the vwp, marry, then say you have changed your mind and decide to stay in country.
Coming to marry as long as you leave again, is perfectly acceptable. Many, many people here on the forum have done just that.

It will have no effect on a future move to the UK.

As larrabee said, it would only be fraud if you entered the US as a visitor, claimed you were going back to the U.K. after the wedding, but then did not take your flight home and applied to switch status to a US spousal visa/green card from within the US... because you would have come to the US as a visitor under false pretences.

There is nothing wrong with marrying in the US as a visitor, then returning to the UK to live, with your spouse moving to the U.K. as well.

If then several years later, you choose to move to the US by applying for a spousal visa at the US Embassy in London, that will be a completely separate situation and will have no connection to you getting married in the US when you were a visitor.

It is not immigration fraud at all. I checked all this back in 2013 before marrying. My British hubs flew to the US with an ESTA. We got married. Then he went back to the UK.
