After some bad news today, we might be putting this application on hold again :( . Can someone explain qualifying by Category B please.

I would need 12 months bank Statements
12 month pay slips and what else?

This all sucks so bad because we literally got this job letter signed on Sept 3rd. His boss said he would confirm any information needed by immigration, but even paying priority there is no guarantee that we would get an approval in 30days.

Anybody have any thoughts? We are conflicted on what to do.

Sorry to hear that :(.

Even if you could still get it processed in 30 working days, you would still need to make sure the same employment situation was valid on the date you entered the U.K. (you need to be able show your circumstances haven’t changed since you applied).

For Category B, the only difference is the 12 months of payslips and bank statements.

So you need:
- 12 months payslips showing a total pre-tax earnings of £18,600
- 12 months of corresponding bank statements
- letter from employer stating he is currently employed with them and earning £18,600 or more
- job contract
- latest P60

Is it £18600 or £24800 (me and 2 dependents). So we wouldn't need a job letter? Just a new contract?

Sorry, I meant £24,800.... I’m so used to writing £18,600 that I did it automatically.

No, you MUST have a new letter... it was third on my list. No letter = automatic visa refusal.

The MANDATORY documents are:
Requirement 1 (previous earnings):
- 12 months payslips
- 12 months bank statements
Requirement 2 (current and future earnings):
- new letter from employer dated in last 28 days before applying

The Optional documents are:
- job contract
- P60

So another question

Do you guys know if I have to get the court order redone, if I am moving to another address?

The court documents state 1 address but we will be acquiring a different property.

Can a simple letter from me be sufficient explaining the change of address or will my sons dad have to write a letter ( he is literally the hardest person on this planet to deal with and probably will not write the letter freely)

Let me know your opinion.

Big hugs Kelks.  Sounds like you need several today!

I would think the court order is valid no matter what address you are at, but you may want to clarify with your lawyer.

I'm literally in tears...this has just been so hard...and tomorrow is my birthday so sending off the paperwork was suppose to be my official birthday present.

Life a little bit unfair right now..We moved into a 3 bedroom this Tuesday (after searching forever, lots of space and in our budget) and to be forced to resign the day after, is just unfair.

His Boss said he would still verify the information as he would still receive his income in 30days but that is no guarantee and priority might hit happen before that and we would have to land all within 30days.

I’m sorry this is happening.

Unfortunately, if he is being forced to resign, you aren’t going to be able to use his job to meet the requirements... because:

a) he won’t be employed there anymore by the time the visa is granted

And

b) in order to provide a letter, his boss would have to lie to the U.K. government... because that letter has to guarantee that the job will continue for the foreseeable future... which it won’t

Also, remember, it’s likely to take at least 30 WORKING days for the visa to be granted... and that time doesn’t start until after you have given biometrics and Sheffield have received the documents.

So even if you applied today, you would be looking at maybe 2 weeks before the processing time starts and then maybe another 6-8 weeks to get the visas after that.

And if your husband no longer has his job after 30 days, and Sheffield find this out while the visas are processing, they will refuse them. And even if the visas are granted, they may ask about his employment when you enter the U.K., to make sure he’s still employed there, and if they see he no longer has the job, they could cancel the visas at the border and send you back home.

Yes I know everything is on hold. He is trying to get a job starting October 1st and then we are going to try for the 1 year rule instead, until that happens we are sitting ducks, and if that doesnt happen then we will have to wait 6 more months.

It all just sucks.

P60
Job letter -new job
Job contract-new job
Correct Appendix 2

Anything else?

Congratulations on his new job :).

Yes, I think that looks about right, though we can double-check everything for you when you’ve gathered it all :).

Okay..I'm going home to check the payslips because he already left those with me, I have p60 in hand too.

Told him I would ask in the group so I know what he needs to get. He already plans to ask boss on Monday for job Letter.

Hoping to submit in 2 weeks.
Congratulations on his new job :).

Hi All,

Another quick question, do we need the new job contract? We received it via dropbox and its not on company paper or even signed (they also spelt his name incorrectly on it.

Is it mandatory? Or can the printed one from drop box work. (the job letter confirms all the details in the dropbox document.

Please let me know

TIA

The employment contract is optional but recommended.  How badly misspelled is your partner's name?  Would it cause the ECO to think it's a different person?  If it might be confusing, I'd probably leave it out.  But otherwise, a home-printed electronically delivered one is acceptable, as you can only give Home Office what you were give.  And, again, the contract is optional, anyway.  :)
