I wouldn't risk working. You will have to explain what has happened here in every future visa application.

I can't not work though...literally, I rely on this job. It's not financially possible for me to not work.

As has been mentioned, this is definitely one to get your MP involved with ASAP. Although the visa has been issued in error, that's the visa you have so you have to abide by the restrictions.

But how do you abide by the restrictions if you LITERALLY cannot afford to? I mean, like I won't be able to pay rent, electricity or buy food. It's not like we have savings, etc. I have £25 in my bank account. And it's insinuated that this could take months to sort.

Is your partner exempt from the financial requirements? As your sponsor, they are responsible for you.

No he isn't. But he can't afford the apartment and electricity on his own as they exceed his income. I was able to work on my previous visa and then was continuing my job and paying some of the bills from the US.

I'm really sorry.  :-\\\\. I would still try to find another way to pay the bills. Working on a visa that doesn't permit work is against the law.

Email your MP now.Leave a message. Call them first thing. Keep on them until you get a result.

I'm unsure what "another way to pay the bills" is...you can't get money for not working. This is so stressful.

Perhaps I should just return to the US until this is fixed?

Unfortunately this is really something that should have been checked as soon as you got the visa, before booking your flights.

- The first red flag would have been the fact that it was valid for 6 months and not 30 days
- the second red flag was the ‘no work’ printed on the visa
- Did you receive a letter with your visa telling you when and where to pick up your BRP? If not, that would be the third red flag.

It’s an easy fix from inside the US, but unfortunately not quite as easy once you have entered the UK.

I didn't get a letter. I assumed it was something to do with the new system and that I would be allowed to work once I got the BRP card. I had also just gotten a call that morning telling me my FIL was about to die that day (though thankfully he didn't) and I was trying to get back to the UK as fast as possible.

I also can't take a break from work for the unforeseeable future, as I guess this appears it's not an easy fix.

I've emailed my work to let them know what's going on...but I have no idea what this is going to mean...a financial disaster if this months to sort out...

Ah, of course with your FIL’s health, it’s understandable that you were rushing to get back and weren’t thinking about the visa so much.

The only thing that has changed with the new system is that New York receives and scans the documents.
Everything else is the same - you need that letter to pick up your BRP (and you’re supposed to show it to immigration when you arrive at the border), so the fact that you didn’t get one meant that the wrong visa had been issued.

The best thing to do is follow the advice given on this thread and contact your MP ASAP to try to get it sorted out.

I shouldn’t think it would be months. They’re usually pretty speedy when they’ve made an error - especially if your MP gets involved. Hopefully you’ll be able to get it sorted by Christmas.
