Speeding ticket in USA - where to report on SET(M)?
« on: January 14, 2019, 01:36:45 PM »
Hi there! I am applying for SET(M) this month and I am a little confused about how to report a speeding ticket I received in 2017 in NY State.

I was pulled over while travelling for speeding (77 in a 55 eeepppp I know) and received a ticket that required I show up in court, which I did not do as I was back in the UK by the date it was for. I received a fine ("guilty plea") in the post to my parent's address in the US (where my license is registered to) and a fine of $233 that I paid in full. This was on my US driver's license (I don't hold a UK license/don't drive in the UK).

Do I need to report this? And if so, in what category do I report this in the SET(M) form? I am a bit confused if it should be reported as a penalty for a driving offence when it didn't have any effect on my license, just a fine that's now paid.

Thanks a ton!

They've updated the form so that it's online now and we can't "see it".  There should be a question about if you have had a criminal penalty or conviction of any type and that is where you would answer.  Then include the detail in a cover letter and a copy of any paperwork.  You'll need it all for citizenship too if you decide to apply.

Hi KFdancer,

The form says this:

"At any time have you ever had any of the following, in the UK or in another country? (Required)
Only select one answer at a time. If you need to give more than one answer, you can do so on another page.

A criminal conviction

A penalty for a driving offence, for example disqualification for speeding or no motor insurance

An arrest or charge for which you are currently on, or awaiting trial

A caution, warning, reprimand or other penalty

A civil court judgment against you, for example for non payment of debt, bankruptcy proceedings or anti-social behaviour

A civil penalty issued under UK immigration law"

... which category should I put it in? A penalty for a driving offense or a civil court judgement? And I don't have the payment receipt as my dad paid it for me (nice dad I know), all I have is the notification from the town's "Justice Court" of the fine.

Thanks.

A penalty for a driving offence.  Then include the paperwork you do have (keep a copy).  If your dad has proof of payment, that would keep it neat and tidy but you can't make something appear if you don't have it.

I had this as a worry when I originally applied for my first visa. As the penalties happened before I even met my husband, I did not keep receipts or anything. I got an official copy of my 10 year driving record, and in-depth detailed each circumstance (I promise I'm a safe driver, I'm just one of those goody-two-shoes who gets caught in a trap the one or two times I actually did speed). I don't know if it will have an affect on citizenship, but should not be an issue with the visa as long as you are honest. I don't remember if I dealt with in in my FLR(M) application, but I kept the driving record. Have had nothing since 2011, but I would still include it. I remember though, I had more of an issue with the wording of the question on my original visa application more than anything. I think then, there were separate questions for penalties and offenses that you had to plead guilty though...even though in america we have to accept a guilty "plea" when getting a speeding ticket (as you said)....so it was very confusing and scary.

Thank you both! I will include the scanned copy of the fine that I have. When I asked my father for a receipt, it turns out that he had paid the required minimum payment of $100 instead of the full $233 owed so I have now paid the fine in full and will include this in my application.
