Having trouble filling out form 2555 with H and R block site.
« on: February 24, 2019, 06:23:37 PM »
Hello,
I was wondering if someone could help with an issue I am having trying to fill out my taxes and in particular filling out form 2555.
Here is the question,
Wages and Salaries
Since you want to claim the foreign earned income exclusion, tell us about any wage income you want to exclude. This can include:
Wages
Salaries
Bonuses
Commissions

So, I enter in my wages, which I have converted to US dollars and keep getting the following error issue message.

Issue 1 of 1 The excluded wages in the Foreign Earned Income Exclusion (Form 2555) topic can't be more than wages in the W-2 or Foreign Wages not on a W-2 topics. Review what you entered and make sure it's accurate.

I haven't worked in the US for a few years, so don't have a W-2. Didn't fill out any information on the W-2 form on their website as I don't have one. I even deleted the W-2 form bookmark. And yet I still get keep the same message. I have done 3 chats with someone from H and R and in the end they can't figure it out and say I need to get in touch with one of their tax specialists which will cost an aditional $39.

Can anyone figure out what the actual issue is and how I may correct it. I am not being asked to fill out any other forms. Any ideas. Thank you.

I have only been through this once, with my son for tax year 2017 so apologies if the line numbers are wrong for 2018. The foreign wages must be reported on the same line as W2 wages, line 7 . The figure entered on form 2555 is then entered on line 21, other income, as a negative value. At least that is how TurboTax produced his 1040 for 2017.

Don't know about the software you are using, but you will also need to calculate non-excluded income such as employer pension contributions.

Hello,
Thanks for your help. Once I understood what the issue was, I was able to figure out how to correct it. After converting my salary into US dollars, do I need to include my P60 or monthly payslips.  From what I have read, it appears that I don't have to include my P60, but not sure about my monthly payslips. Thanks.

You don’t submit either just hang onto them in case of questions from the IRS. I have been reporting UK pension(s) for 12 years now.

Ok, thanks. I think last question. For form 2555 what do I put down for Visa type. Originally entered as a fiancée, but have now been married for 2 and a half years. Do I put down marriage or spousal or leave to remain, etc....

Put the visa you are relying on to satisfy the time period required to qualify for 2555 ('presence' or 'bona fide') at the time of filing. A return with '90 day visitor' would surely raise questions from the IRS. If you're a British Citizen, then 'UK citizen' or 'none required' will suffice.

Hello,
Sorry, I should have been more clear. Would I put down Biometric residence permits (BRP). Is it FLR renewed. Basically, moved here on 6 month visa till I got married and then applied for the FLR for 2 years and 6 months. Now extending visa for an additional 2 and a half years. Or is it limited leave to remain. I believe it's limited leave to remain or should I just put down leave to remain.

Your current visa is FLR(M) further leave to remain on the basis of marriage. You entered on a marriage visa, a visa for the purpose of marring in the UK with intent to remain.
Your leave to remain is limited.

Thanks. For a second thought I also may have done something wrong when I printed out the new 1040. Thanks everyone for your help.

Hi! Can you explain how you fixed it? I'm having the same problem with the H&R Block program. Thanks!

I am having the same issue. How did you figure it out? I am in the exact situation.

Thanks!

I also figured it out.  Anyone else looking at this thread and using H&R Block, on the Income section it asks whether you have any other income.  Click Yes and it gives you the option to report any income not on a W-2. Hope this helps!

Cheers, justdoit1!

Though I figured it out eventually last year, as shown by my above posts, I completely forgot how to do it this year too, and remembered this post. Good luck to everyone and the joys of doing their tax returns.
