URGENT: Form 2350 and FEIE
« on: April 14, 2019, 01:38:25 PM »
I thought I had everything figured out with regards to my taxes until I read form 2350 which seems to imply that I won't get the foreign earned income exclusion if I don't file this specific form.

I was under the impression that I am granted an automatic 2 month extension to file my taxes (without having to file any extension forms) as I am living in the UK.  I meet the 330 day physical presence test on April 29th, 2019 and am worried that if I don't submit a 2350 today I will be assessed with a late filing penalty and be unable to exclude my foreign earned income in the UK from US tax (as I am with a PAYE employer in the UK and have been paying tax).

Can someone please confirm whether I need to file a specific form (2350) in order to receive FEIE?  Or can I receive FEIE with the automatic 2 month extension to file from living in the UK?

Will you be outside the US (abroad - like in the UK) on 15 April 2019? Will you be filing your return before 15 June 2019? If the answer to both is 'Yes', you do not have to file Form 2350 and you will be able to file 2555 as normal, and not be assessed a late penalty if any potential tax due was remitted on or before 15 April 2019. If you will be filing the 2018 return after 15 June 2019, then file the form 2350.

Read the instructions carefully   :)

"File Form 2350 on or before the due date of your Form 1040."

If you're "out of the country" on 15 April 2019, your due date is 15 June 2019.

"However, if you have 2 extra months to file your return because you were “out of the country” (defined next), file Form 2350 on or before June 17, 2019.
“Out of the country” means that on the regular due date of your return, either (a) you live outside the United States and Puerto Rico and your main place of work is outside the United States and Puerto Rico, or (b) you are in military or naval service on duty outside the United States and Puerto Rico.
You don’t have to file a form to get the 2-month extension because you were out of the country. But you will have to attach a statement to your tax return explaining how you qualified."

Attach a simple statement to your return stating you were "out of the country" on 15 April 2019 at your permanent residence in the UK.

I honestly have no clue how I didn't catch that bit about the normal filing date of the 1040! Thank you so much! The answer to both is yes so I won't need to actually file an extension, as I get the automatic 2 month one. I'll be sure to include a statement.

I've been reading a ridiculous amount of tax stuff over the past month and I think I reached the breaking point today.  My wife even brought me out a beer today as she saw I was at my wit's end and was freaking out hahaha.

I only have one more question: does the IRS accept scanned originals? If I were to sign and scan something over to my family in the US for them to print out and mail in for me, if that accepted?
