Missed tax year need help please!
« on: October 17, 2019, 11:16:00 AM »
Hi I moved to the UK 2 years ago this month (October 2017).

I filed my taxes for the year 2017-2018 but I did not file this past January for 2018-2019. I was unaware I needed to file. I didnt work most of the year till end of october and only made just around £1000.

I got a brief explanation that said if I file this year I need to file married filing seperately (so my husbands income isnt included) if I make more than $5 in a year which I have. But I am nervous now because I didnt file last year.

Is there any advice anyone would be able give me as to how I can correct this? Where to go for filing? If I will be fined for last year being missed?
Thanks

Could you clarify your terminology because the US works on calendar years.  When you say 2017-2018 do you mean Jan 1st 2017 to Dec 31st 2017?

If so then you are only a little late on filing Jan 1st 2018 to Dec 31st 2018 so I would just go ahead and file. I would not expect much if any in the way of fines since you won't owe taxes from what you say.

US tax year 2019 (Jan 1st 2019 to Dec 31st 2019) is not due until June 15th 2020 for overseas residents.

I was late one year many years ago, and I owed taxes as I hadn't witheld enough. Turbotax calculated the penalties easily enough.  I would just go ahead and see what Turbotax comes up with.  If the late fees look high then think again but I think the penalty is just 5% of the tax owed.

Quote
The penalty for filing late is normally 5 percent of the unpaid taxes for each month or part of a month that a tax return is late. That penalty starts accruing the day after the tax filing due date and will not exceed 25 percent of your unpaid taxes.

Since you were resident in the UK in 2018 Turbotax will walk you through the process to exclude that foreign earned income anyway so you won't owe any tax. You are are allowed to exclude up to $100k of earned income each year. Our son uses Turbotax each year to exclude his UK earnings.  It is IRS form 2555.

Exactly right.  Just the cost of paying for Turbotax each year.

Just curious, can you efile with turbotax while you have a non resident alien spouse? I couldn't with taxact and that was annoying.

No idea, never needed to try that. If OP is in that situation then there would be the extra expense of sending in a paper return.

So I am on turbotax but it gave us package options and now wants billing and shipping info? What does this mean is it cause we are late we have to file by paper now? Or is it something else?

Ok so turbotax wants an address and card info from either US or canada and were in the UK how exactly do we go about doing this? Have you filed using turbotax in the UK past the Oct. Deadline?

I still have a US credit and debit card so have not run into this problem. Is this problem happening because you are trying to buy a copy to download on your computer? If so you could try filing using Turbotax online and see if it accepts a non-US credit card. I'm sorry you are having this problem. TurboTax definitely supports US taxpayers overseas so it seems short-sighted of them to not allow any of them to pay them to file their taxes. I expect buying TurboTax to download without a US credit card may be a licencing issue but surely they can let folks pay for it online. My daughter always uses the online version whereas I always have liked the extra flexibility and features of buying, the more expensive, downloaded version. (My daughter lives in the USA)
