we had a hiccup...we're looking to move back...whaddya think?
« on: January 03, 2005, 09:18:00 PM »
Hello everyone, LTNS hope the holidays were very good!!!
I have a new and exciting yet frustrating controversy on my hands...and need a little advice if I can please :)
I moved to UK in the end of August on a spousal visa to be with my husband, marriage is great, England however, sucks!! (theoretically speaking for my family life that is)
My sons father is in the usa, my daughter and alllllll of our family is in the usa as well. Husband and I decided (FINALLY) that there'd be a heck of alot happier faces and people if we moved back to the states.
Now....can we do this realistically?????
I would go home and get a job and on my feet and be able to prove supportive if need be ahead of time, the wait right now is that I'm pregnant and we want to be together when the baby is born, and honestly a move right now to get all of these things sorted would be too stressful to the pregnancy anyhow...
SO..sometime after September, I plan and fully intend to get my fanny to the states and get on my feet and get my husband here....
any ideas, suggestions as to how to go about this, or are there any loopholes we can jump through so that we don't have to go thru the process as we did to get my visa???
MUCH appreciated
Wife to Karl, mother of 3
back in the USA to stay

Unfortunately I have absolutely no advice-- but just wanted to wish you luck on this next chapter!

http://travel.state.gov/visa/immigrants/types/types_1315.html#1c

describes your choice of immigrant or nonimmigrant visas for your husband.  Looks like straightforward paperwork to me.  Probably less effort than finding a loophole.

Sorry your move has not worked out for you.

Hiya - best thing you can do is contact the Embassy in London and ask them if they'll process your petition for your husband to join you in the US while you are both here in the UK. They can do all the processing at the Embassy as a priviledge to Americans who reside in the UK. It can be relatively quick and painless if they allow you to process via this method which is called Direct Counsular Filing (DCF). The only snag I could see with this is that you have only been in the UK since August. But if you explain to them that there's a baby on the way and you really dont want to stay in the UK after having given it a genuine shot they may allow you to submit the petition. Theres lots of posts on this forum about DCF and how to start it as well as how to get in touch with the Embassy. I hope you find the information you need and I hope your prospective move back to the US is a good one!
