Topic: Merry Christmas! Question on applying for Citizenship  (Read 1544 times)

Merry Christmas! Question on applying for Citizenship

Hola Everyone! (I'm taking Spanish language lessons)

It has been a difficult year for myself and my daughter (age 17). Some of you may recall, my wife was diagnosed with lung cancer last October 2018. She passed away on February 28th 2019, 5 short months later.

You may also recall that my wife was a British citizen, I'm American. With the help and guidance of many people here, I've managed to receive my ILR status as the widowed father of a British citizen. Yay! Thank you all...

Now, my daughter is doing very well with her A-levels taking Computer Science and Maths (as well as Drama) She is planning on attending University in America ... looking at Harvard, Yale, Uni of Chicago. But... she has Type 1 Diabetes and I've been cautioning her about the state of health care in America - to no avail.

So, with that in mind, I am looking at British citizenship to be able to come back and forth if need be, as I am longing to return to the US. As just about everyone asks me: "Why did you move to England when you could live in Florida?" lol

Question:
Am I right when I research this subject, that I will need to be resident in Britain for 12 months once I've received my ILR in order to apply for citizenship?
Or, is there a special application for the widowed father of a British citizen? etc.

Unfortunately, I am not aware of any special provisions that would allow you to bypass the 12 month wait. 

The immigration rules allow you to immediately apply for ILR if your partner passes away (regardless of how long you've been resident in the UK), but the naturalization rules do not appear to have a similar waiver.

I am so so very sorry for your loss. My husband and I are about to apply for ILR for myself as my visa expires soon and we just took him for tests for suspicious symptoms last week. Currently waiting on the results, and my biggest fear other than loosing him is that I will get kicked out and he will be suffering alone. I'm so glad for your wife's sake, that you were able to be there for her. I am so sorry you have lost her.

Another related question:
Meanwhile, while we are in the process of applying to American Universities = a question pops up...
My daughter is a British citizen but was born in America so she has 2 passports - for for the UK and one for the USA.

On the application they ask "citizen of what country" ... if she puts British she becomes an international student.
Then they ask "what is your visa status" ... would that be:
1) a visitors visa (6 mo) ?
or 2) a student visa (which we would need to apply for (i guess)) ?

Or does she say she is an American??

You may want to contact the university to ask. Often fees are based on residency not citizenship, so she will be an international student anyways and she just won't need a visa.

From an immigration point of view, she must put US citizen - because the US officially ‘does not acknowledge’ her UK citizenship... to them, she is a US citizen and a US citizen only (it is actually illegal for a US citizen to enter or leave the US on a foreign passport).

Also, if she puts that she’s British, the university will then require her to apply for a visa to study in the US, which she does not need because she is American (and she probably cannot qualify for a vis anyway as she already holds US citizenship)

Therefore, putting anything other than US citizen will just open a can of worms you do not want to open. And why make things complicated for yourselves when you don’t need to?
