Traveling before ILR application
« on: February 20, 2020, 10:05:25 PM »
My husband and I have plans to visit the US together this summer. My spouse visa (it's the 5 year visa, as my husband's in the military) expires on July 22nd. Due to other time constraints/commitments we have in August, we *may* need to go before my visa expires. We'd apply for it when we return to the UK.

Is it okay to return to the UK like a week and a half/2 weeks before my visa expires? We'd gather as much info up as we can before we leave, so the application is ready to go when we come back.

I'm currently in the US staying with my family while he's working in the Middle East. I go back to the UK in several weeks, and he's back in early June.

What date did you enter the UK for the first time on your current visa (the date should be in the entry clearance stamp on your vignette in your passport)?  You can apply for ILR up to 28 days before you reach 5 years from that date, which could be weeks or months earlier than July 22nd.  You might have more time to apply than you realize before your trip.

But, yes, as long as your visa is valid, you are fine.  The officer will probably say something about the close expiry date, but just tell him you're aware of it and that you are submitting your application in X days.

You may need to check with the airline too, they often won't let you travel if your passport is expiring soon so unsure if they will do the same with visas.

The visa just needs to still be valid on the date you land.
