And here is me thinking that another 6 months on FLR(M) which would total to 3 years and married to a BC would allow her to apply for citizenship, the fact that I even thought the Home Office would make it that simple makes me want to smack myself over the head! Thanks all for the replies :-)

Yeah, it’s annoying.

Thing is, they are two completely different sets of rules, so just because citizenship is 3 years, doesn’t mean you can qualify after 3 years, because ILR is 5 years and you need to hold the latter before you can qualify for the former.

Before July 2012, it worked as follows for people married to UK citizens:
- one 27-month spousal visa
- apply for ILR after 24 months
- apply for citizenship when you meet the 3-year requirements (time in the UK on other visas before the spousal visa could count)

In July 2012, they rehauled the settlement visa system so that it works as follows (for spousal visa holders. People on fiancé visas have to apply for an extra FLR(M) visa):
- one spousal visa valid 33 months
- one FLR(M) visa valid 30 months
- apply for ILR after 60 months (5 years in the U.K.)
- apply for citizenship as soon as you have ILR and can meet the 3-year citizenship requirements

For people not married to U.K. citizens, it has always taken 5 years to get ILR then another 12 months to get citizenship... so it was just that the settlement visas were changed to increase qualifying for ILR from 2 years to 5 years.

The only members we have had be successful for free appointments were ones who could wait 6-8 weeks for the biometrics.  The decision will come 6-8 weeks later.

As always do NOT book travel until after your wife has her new (correct) BRP in her hands.  While they've been better lately, we've seen several members wait nearly a month for the "24 hour service".  Again, the last few months have been smoother.  But you can't take anything at face value with UKVI.

I arrived here Oct 26 2017 and my BRP expires june 29 2020.  A question regarding the above quote. I dont think i would get the 24 hr service, so im wondering, as long as i applied and sent my information/documents and paid my fees before 29/6/2020 i am good? or must i have attended my brp appointment before 29/6/2020 at which case applying first week of may is a good idea? and then of course there is the 6-8 weeks before a decision so for all that time after 29/6/2020 am i alright to work? to live here? gah!

on that note, i am usually paid on the 28th of each month, so trying to plan ahead and make things straightforward for me in terms of documents needed.

also, just want to give a little praise to everyone here who are stellar at replying to the posts on this forum. yall are incredible, the way you guys know sections of the law and guides is amazing. and how you can figure out the dates, and documents needed for each case. just. wow. a very big thanks to you all.  [smiley=hug.gif]

As long as you have submitted and paid for your online application before your current leave to remain expires, you will be protected under section 3c of the immigration rules. It doesn't matter if you have not yet attended your biometrics appointment.

Just wrapping up the FLR (M) application online. It’s pretty self explanatory and similar to the first one. Quick question. On the type of visa page where it comes up with a list with radio buttons.

Can I double check that the type of visa is FAMILY and NOT SETTLEMENT?

Also, when we need to provide the financial information does it suffice to provide my applicants payslips and corresponding bank statements (as she is the main applicant) or do I also need to provide my own (as the partner) or do we need to provide both sets....?

I think most people choose Family although Settlement would not be incorrect either.
If one of you meets the income requirement then only mention their pay in the application and only include their financial documents.
Only include both sets if you actually need both to amount to £18.6k.

So application submitted, all done, IHS fee paid for and application fee paid for.

Now.... coming to booking an appointment (no appointments available anywhere in London as of yet)

Next question, under the document upload category on the SOPRA STERIA site.... do we need to upload ALL the documents (e.g financial bank statements, pay slips, letters of correspondence, marriage certificate etc)

Am I right to assume that we no longer need to SEND anything via post ?! This is all online and uploaded via SOPRA STERIA?

Yes, EVERYTHING is uploaded now (even your passport and BRP) and NOTHING is sent by post at all.

You can either upload the documents to the Sopra Steria website yourself, or you can pay extra to add the ‘document scanning’ option when you book your biometrics appointment and have them scan and upload all the documents for you at the appointment.

Yes. The only date that matters is the date you submitted the online application, because that is your official application date.

As long as you applied online before your BRP expired, your immigration status will be automatically extended under 3C Leave while you’re waiting for a biometrics appointment and for the visa to be processed.

They are slowly opening up the UKVCAS centres, but at the moment, only people who booked an appointment before the centres closed in March, and who then had their appointment cancelled, are currently able to rebook and attend their appointments. Everyone else will still have to wait.

That's good :).

You already have enough sources, so if you can use mailed bank statements to fill in the gaps, you'll be all sorted :).
