extension of spouse visa need help
« on: April 04, 2020, 04:16:19 PM »
Hi everybody!

I am due to apply for my second 2.5 spouse visa. I have a few questions if any one can help.

1.Is this the right form I need to use to apply?
 form FLR (M) Updated 13 December 2018

2. I arrived in the UK on 07/11/2017, my visa expires on 20/07/2020,  what is the window period I can apply. My understanding is its between 09/04/2020 - 19/09/2020.

3. Which is the better financial requirement type?
a. my husband's pensions + savings
b. my husband's pensions + my salary
c.my salary + savings
d.savings only (62,500 pounds for six months in bank)...my preferred option

Thanks

HI June, welcome.

1- It's all online now. https://www.gov.uk/uk-family-visa/partner-spouse

2-You can apply from 28 days before the 2.5 year anniversary of entering on your spouse visa but you must apply before the BRP expires. But it's better not to apply too early in case you are left with a very small window of opportunity to apply for ILR.

3-Savings only, hands down!

You arrived on your spouse visa 7 November, 2017.  Thirty months from this date is 7 May 2020.  28 days before 7 May 2020 is 9 April, 2020.  So 9 April is the earliest you can apply.

You must apply before your current visa expires.  Your visa expires on 20 July, 2020.  So 20 July 2020 is the latest you can apply.

Therefore, your application window is 9 April to 20 July, 2020.
9/1/2013 - "fiancée" (marriage) visa issued
4/6/2013 - married (certificate issued same-day)
5/6/2013 - FLR(M)#1 in person -- approved!
8/1/2016 - FLR(M)#2 by post -- approved!
8/5/2018 - ILR in person -- approved!
22/11/2018 - Citizenship (online, with NDRS+JCAP) -- approved!
14/12/2018 - I became a British citizen.  :)

Just know that right now, you can’t enrol biometrics.  So depending on how long all of this lasts, you may have a wait for that.  Just know that as long as you’ve APPLIED and paid online, that you are “good to go” until everything gets opened up again.

In time and valid applications are covered by 3c of the Immigration Act 1971, which ensures these are not overstayers if their visa expires while a decision is being made by UKVI.
https://www.gov.uk/government/publications/3c-and-3d-leave

An invalid application is treated as if the application was never made. An invalid application is not the same as a refusal of a visa.

Thank you for your reply. I have one further question if you don't mind. I read on another post as below about the same question I asked. the first link in that post is the same link you send me, i would like to know when I  follow the first link will it direct me to the same form (flr(m)as the second link?

our next visa will be FLR(M)... which stands for Further Leave to Remain (Marriage).

You can access it from this page (under "In The UK" where it tells you to apply online):
https://www.gov.uk/uk-family-visa/partner-spouse [nofollow]

Or the direct link to the form is here:

thank you for your reply.  I understand the visa centers closed and there is no priority service till at least 31 May. is it worth waiting till then to apply for priority rather than do it now?

Thank you for your reply. fingers crossed it all work out ok. i planned to do priority service as the first visa took me 83 days which was a very bad experience.
i don't want to go through again. but not sure i can still do priority.
