Another Tax question
« on: June 11, 2020, 09:11:22 AM »
::) Hi everyone, hope all is good.
I have scanned the tax questions for an answer before asking, so forgive me if its been answered already.
My ex in the states filed my 2019 taxes for me and hope to be getting a refund for the time i worked before coming to the UK, but who knows how long that will take.. Question is, i worked from the end of Sept thru December 2019... since already filing my taxes for time worked in the states, do i have to file again for the few months i worked in the UK? I earned less than 4000.00.  Thank you in advance

Are you a US citizen?

Your profile location says Texas, where do you live now and what are the dates you lived in the US and UK?

Hi, Ohhh, I thought I changed my profile. I got here the end of March 2019.. I am in Colne Lancashire now. I worked in Texas until i left in March 2019.
I worked here in the UK from the very end of Sept 2019 to January 2020.
My ex husband in texas filed my taxes for me last month which covered the work in Texas.
I am not sure since I only worked here in the UK a few months in 2019 if i need to file anything.
Thank you

You’ll need to amend your taxes to include your worldwide earnings for 2019.

Is this something I can do next year... on the IRS site regarding amendments it does say you can do it within 3 years from the original refund date.

If that is what it says then you are probably okay if the difference is minor. Does it say anything about penalties or interest because while you have undeclared income your tax liability is higher than the original return so you are effectively borrowing money from the IRS. Personally I would do the amended return ASAP since you are now willfully holding back taxes as you know that you made a mistake and under reported.

I checked on the IRS website and the 3 year option is only for if you are owed money by the IRS. In your case you have undeclared income that you didn't pay tax on so the refund you received should have been less.

You can check yourself by following the IRS simple interactive tool.

https://www.irs.gov/help/ita/should-i-file-an-amended-return

Quote
Balance Due
If your change results in a balance due, file and pay any tax owed as soon as possible to limit interest and penalty charges. Interest is charged on any tax not paid by the due date of the original return, without regard to extensions.

Credit or Refund
If the amended return is filed within three years of filing the original return, any credit or refund will be limited to the amount of the tax paid within the three-year period (plus any extension of time for filing your return) immediately preceding the filing of the amended return.

Be VERY careful - unless they are far more knowledgeable than most, your friend will not have any experience with filing a return that includes foreign income or how to opt in to tax treaty benefits or exclude income (using FEIE) or take credits for UK tax paid against any US tax that may be due. Bottom line, as a US citizen, you are required to report your world-wide income on your US tax return.

You may also be required to file the FBAR form, which is filed electronically and is not a part of your tax return. Start reading here to see if you need to file: https://www.fincen.gov/report-foreign-bank-and-financial-accounts.
