FLR (M) question about first extension or additional extension

I am applying for an FLR (M).

I got my spouse visa in March 2015 but then I forgot to apply for FLR (M) in time in 2017, so I had to fly back to the states and apply to get back in.

Am I now applying for first extension or additional extension?

In other words, does the 2017 application count as an extension or does it reset everything?

I'd say it was your first extension as you've unfortunately had to start again and that's where you are in the process this time.

I read this:

Evidence of Financial Requirements under Appendix FM

"electronic bank statements which are either accompanied by a letter from the bank on its headed stationery confirming that the documents are authentic or which bear the official stamp of the issuing bank on every page."

Do I need to follow this instruction since I am uploading all documents?

It’s asking you ‘as a couple’... so you tick Yes, because you, as a couple, own the home you live in.

The 3 options mean:

I own: you and/or your sponsor own the home you live in

I rent: you and your sponsor rent the home you live in

I neither own or rent: you live with friends or family in the home that they own... you are a ‘guest’ in someone else’s home.

i returned February 2018, after an absence of three months.

28 days before the 5th anniversary of the Feb 2018 arrival.

So the clock reset in February 2018 and I lost the first 2.5 years from March 2015 - September 2017?

Just to clarify from your old posts:

- you applied for a fiancé visa in the US in 2014

- you applied for an FLR(M) extension visa in 2015 after marrying and it was approved in March 2015

- you returned to the US in 2017 to apply for a spousal visa as your first FLR(M) expired before you applied for the second FLR(M)

- now you’re applying for another FLR(M) extension in Oct 2020

However, I’m not sure what happens about the fact that you left the UK and had to apply for a spousal visa.

Without that gap, you would have qualified for ILR in Feb 2020, but I’m not sure if that gap means your 5 years reset in 2018 or not.

It might be that you can actually qualify for ILR now instead of FLR(M)... or it may be that you have to wait until 2023 to qualify. I really don’t know enough about it though.

Vinny at Immigration Boards said that the 5 years has to be continuous:

Two law firms I contacted also said the same thing.

The person who answered the phone at Home Office said that he was not specifically trained to provide guidance and that I should consult the website. But his unofficial answer was that the five years had to be continous.

So I have to apply for FLR (M).
