Date we can apply for ILR?

Hi all,

Firstly I wanted to say again thank you to everyone who has helped my wife and I with our visas over the years!

I just wanted to double check the date on which we can apply for ILR for my wife. The pertinent dates are below:

Date entered the UK (on fiance visa): 18th September 2017.
Date first FLR(M) granted: 7th March 2018.
Date of first FLR(M) expiry: 7th September 2020.
Date second FLR(M) granted: 10th November 2020.
Date of second FLR(M) expiry: 4th June 2023.

Based on the above and reading advice on this forum, I calculate we can apply for ILR anytime from 28 days before my wife's 5 year anniversary in the UK (which I think excludes the fiance visa?) which would mean we can apply anytime from 28 days before 7th March 2023 up until 4th June 2023? Which would be anytime from 9th February 2023 to 4th June 2023?

I would appreciate a quick second opinion to whether I have calculated this correctly!

Yes, time spent on the fiance visa doesn't count towards the 5 years, so she can apply 28 days before she reaches 5 years on FLR(M) visas.

This means that she can apply starting 28 days before March 7th 2023, right up until her visa expires.

So her application window will be:

7th February 2023 to 4th June 2023.

If I may cut in on this subject, would anyone know what happens once you get approved for ILR? (not currently planning on applying for British citizenship)
Do you get another BRP and if so, how long is it good for?  Do you have to keep replacing it?

Yes, you get a new ILR BRP.

Normally it will be valid for 10 years, which you have to renew with updated biometrics every 10 years, like a U.K. driving licence.

However, all ILR BRPs are currently only being made valid until 31 December 2024, because new EEA rules for biometric ID cards are coming in then and they will need to reissue them all to meet the new standards.

Having said that, now that Brexit has happened, I don’t know if the UK will still be adhering to those new regulations or not.
