I have informed my temp agency who is speaking to my employer (they placed me there and I was only there for a week)

So hopefully that is sorted without them being in trouble!

I would think at this point its possible the temp agency would be fined as they had all of my information on file and didn't check it. I hope no one has any fines though!!

It's not just the employer, but can be the worker too. The Immigration Act 2016 brought in the changes.

You will be fine. You have legal representation now. While technically “ignorance” isn’t an excuse, it’s sooooo obvious this was 100% an innocent mistake.  It’s just a massive bummer you didn’t check the date one week earlier!

One day you’ll be laughing about this....  might be awhile, but it’ll happen!

A few years ago the UK brought in an extra 28 days  allowance after the visa end date date, for genuine people like you who missed their end date. Unfortunately they had to close that down as some people just started using that as an extra 28 days on their visa, which was not in the spirit of that 28 days allowance. The Home Office do understand that people forget and you have a legal advisor now.

I believe there is now a 14-day allowance though, where if the application is made within 14 days of the BRP expiry, AND you have a good reason why you could not apply in time, the visa can still be processed and issued.

There is still a 14 day allowance, thankfully, which I may make by the skin of my teeth.

Just waiting on one last document from my husband's employer. Fingers crossed that comes in today and then it is all up to the solicitor.


One day we will laugh.
For now we will obsessively clean, play Stardew Valley and drink far too much coffee.

I think we talked about this on Advisories when the 28 days allowance became the, 14 days if there was a very good reason?

You aren't the first to forget to renew and you won't be the last.
