Hi all,

I file using old school hard copy signed paper forms. I haven't tried any electronic ways of doing this that allow the flexibility I have learnt to use with filing treaty positions, 1116 AMT, writing EXEMPT on lines (around owing SS for self-employment etc).

I sent this out 2 months ago, tracked mail and remember checking the tracking to see it was delivered. However, I have been using the IRS tracker/checker with my details and there still is no record of my form in their system (I am due a refund from the additional child tax credit).

Is this normal? I'm sure it has been quicker in previous years. When should I consider sending the same return in again?

I wouldn't send a duplicate if it's only been two months unless the IRS advises you do so. You can phone and ask for a tax transcript, and they can tell you at that point if they have it in the system, but I'm not sure that would be any more current than what is online though. If it hasn't been entered into the system by late May I think I'd contact them, if it were me.

As a benchmark: My daughter sent hers there (the Austin, TX office) again in mid-February  for a 2019 1040, as the original disappeared after arrival in April of last year and the IRS advised sending another copy, marked "duplicate". It is just now showing up as "processing" in their system.

Like you, in the past I have filed all my taxes in paper form and mailed them to the IRS in Austin. It's been a real pain to be fair, especially when I made a simple error on my 2017 return that software would have picked up and corrected - it was a complex return with Capital Gains, Treaty position, AMT 1116, 5471 (shares/ownership in a foreign corporation & the subsequent disposal and capital gain) etc.The IRS have been particularly unforgiving and that return is still not finalised - lesson learned for me.

This year (2020 return) I have succumbed and resorted to using TaxAct, which I can thoroughly recommend - it handles all issues that seem to be relevant (to me at least!). You can choose to go the quick entry route and answer questions or tailor your return to manage more complex matters - here's a screenshot list of all the forms that show as available

The biggest challenge for me was buying the software with a UK credit card, but there's a workaround there also using a 'white address' of your own street address and the TaxAct office city, state and zipcode address. Worked for me, and e-filing is so much more easier - instant acknowledgement of filing receipt and tracking of refunds on line.

Will TaxAct let you e-file "Married Filing Separately" with NRA spouse (i.e. no social security number or TIN)?

Not sure - my daughter will be filing as MFS with an NRA spouse. I'm completing her return at the moment with TaxAct and will let you know very shortly if it e-files or whether it is rejected because of the lack of a SSN.

Thanks for the replies, Nan D. and Smitch, much appreciated.

I will wait another month before phoning then. A little annoying as this time last  year I had already received my cheque from the IRS, but this year its not even on the system! It is likely though that the whole stimulus and COVID has slowed paper submissions right down, but I always worry that in sending a paper one it can easily get lost even if delivered.

Will also consider TaxAct next year as you suggest, Smitch. Sounds much better. Did you do the tailored version then or the more automatic one? I guess I would have to opt for the "self employed" version as my wife is a sole trader and has her own business. My concern is will programs like this force me into filing Schedule E, as being in the UK my wife is exempt from paying social security tax, etc...

What I'd say with Tax Act is that you can actually register for it (without paying for it) and complete all the information as if you were going to file. What it won't let you do is e-file or print the return without first paying.  The beauty of this is that you can actually prove and check your own manual calculations. It's almost try before you buy.

They also have a free-file version but I suspect you won't qualify.

I personally started with the automatic return to start with but then tailored and added to it by selecting and adding required forms such as 8833 (Treaty) 8938 (Foreign Assets) 5471 (All schedules - Foreign Corporations) and Form 1116 Tax Credit Carryover calculations.

To be honest, I'm not sure how it will treat your wife's sole trader business - I have my own business but set up as a limited company with me as the only employee and small salary and the rest in dividends - one of the reasons for filing 5471 but no social security considerations because I pay UK National Insurance only.

UPDATE: it has now been nearly 8 months since I filed. I rang up the international help line for the IRS in June, and a rather unhelpful agent took my call, eventually found my form and said they had received it in March. I then mentioned that I will then just wait for my refund cheque...to which she was surprised I was due a refund. I explained I have the additional child tax credit due (as have 2 USC children) so a refund of 2800USD was calculated. She eventually after much confusion asked me to fax (!!) her my 1040 with line 28. I had to do this separately as I don't have a fax, and have heard nothing since I sent it.

I checked the app and sure enough, if I enter my details and put $1 as the refund, it recognises the details.

What should I do here now? My form clearly states I am due a refund, I have it here in front of me! Should I resend with a covering letter?? I have tried to phone again just now, however they ended the call as the call volume from international callers is too high right now...
