Topic: Can I have a spousal UK visa if husband is resident in different country  (Read 1013 times)

Hi all,

My husband and I recently left the UK (last year) for an opportunity abroad. I wasn't finished with my FLR(m) and thus haven't been able to receive my ILR.

Due to his work, he has to remain in the abroad country for another year or two. Would I be able to get another spousal visa in the UK, relocate to England while he comes every three weeks to visit, but he's based in the other country while he finishes a work opportunity?

Thank you for any insight you may have for me.

Unfortunately, he would have to move back to the UK with you, because one of the requirements of the spousal visa is that your UK sponsor must either already be living in the U.K. before you arrive, or must be moving back with you and entering the UK at the same time as you.

Not to mention that in order to meet the financial requirement using employment income, your husband must have a evidence of a job with a UK employer that is based in the UK.

And in order to qualify for FLR(M) and ILR you would have to prove that you and your husband have been living in the same house together in the UK for the entire length of each visa.
