FLR (M) Checklist

Hi all,

We are coming up to my wife's FLR(M) application and I just wanted to double check our list for the application. Grateful for any thoughts.

Current visa expiry date: 19th September 2021
Planning to submit application on: 22nd August 2021 (exactly 28 days before expiry)

List of documents

Applicant Documents
1. Wife's US passport with every page scanned
2. Signed sponsor declaration
3. Part 1 Consent to Checks form signed by applicant (part of the online form)
4. Part 2 Consent to Checks form signed by sponsor (part of the online form)

Proof of Identity/Travel History
1. Current BRP scanned both sides
2. My UK passport (with every page scanned)

Finances
Option 1 - Cat(A) - Salary over £18600 (Wife's salary used here)

1. Printed payslips, each signed by HR from wife's company:
January 2021 - July 2021 (7 payslips, paid on the 28th of each month)

i.e. last paydate will be 28th July which is 25 days before our application date.

2. Letter from HR setting out:

i) Current employment and salary
ii) Length of employment
iii) Length of time earning current salary
iv) Type of employment (full-time)
v) Table confirming each payslip, the day it was paid in and the amount

Plus copy of employment contract

2.  7 original bank statements covering 21st Jan 2021 - 21st August, covering all payments from above

3. P60 from March 2021


Residence in the UK
1. 2 Printed Tenancy Agreements covering Sep 20-Sep21 and Sep 21 - Sep 22, which are in both of our names
Question: Is this enough, do we need documents with original signatures?

2. Original council tax bill for 2021-22 (in both our names)

Cohabitation
Letters covering August 2019 - August 2021:
(Joint meaning it's in both of our names, all original docs)

1. Joint bank statement from 21st August 2019
2. Joint bank statement from 20th December 2019
3. Joint Council Tax Bill from 13th March 2020
4. Joint bank statement from 19th June 2020
5. Joint Water Bill from 16th September 2020
6. Joint bank statement from 21st December 2020
7. Joint Council Tax Bill from 1st March 2021
Note: This is the same document used above to prove residency, am assuming this is OK.
8. Wife's Broadband Bill from 11th June 2021
9. My DBS check confirmation from 28th June 2021
10. Joint bank statement from 21st August 2021
Note: This is the same document used above to prove finances, am assuming this is OK.

One quick question, we moved flat in September 2020. Am assuming this won't be an issue, and we can mention it on the covering letter?

1. Original marriage Certificate

What date did your wife enter the UK on her spouse visa?


Your list looks good, assuming no prior marriages or children for either of you.  You don't need all of those cohabitation pieces of correspondence.  Just pick six evenly spaced ones with both names and come from three or more different sources.

Moving house isn't a problem as long as you both moved to the same house.  ;)
9/1/2013 - "fiancée" (marriage) visa issued
4/6/2013 - married (certificate issued same-day)
5/6/2013 - FLR(M)#1 in person -- approved!
8/1/2016 - FLR(M)#2 by post -- approved!
8/5/2018 - ILR in person -- approved!
22/11/2018 - Citizenship (online, with NDRS+JCAP) -- approved!
14/12/2018 - I became a British citizen.  :)

Thanks so much.

She entered the UK on her spouse visa on 24th December 2018 and the BRP is valid until 19th September 2021. (We applied from overseas)

On the cohabitation correspondence, we struggled to space things exactly 4 months apart at a time using 3+ different sources, so this was the best we could do. i.e. we had awkward 5/6 months gaps unless we filled it with a bank statement as filler, so thought to go with a few extra just to be safe.

I guess we should mention that we moved house (together!) in a covering letter just to make it clear.

Since she entered the UK on 24th December 2018, she has actually been eligible to apply for FLR(M) since 27th May 2021 (28 days before reaching 2.5 years in the UK).

So, she doesn’t have to wait until late August to apply if she doesn’t want to, she can apply any time from today up until 19th September.

It's perfectly fine to have just 2 other items then all the rest bank statements.

Ah thank you so much.

So we were concerned about the timings around applying for ILR in a few years time? i.e. we've seen the recommendation about waiting to apply for the 28 window in order to make sure that this is our last FLR(M) application and we can do ILR straightaway next time?

But maybe this doesn't apply if we started on a spouse visa with a 33 month window for starters? (i.e. we've got 3 extra months than I had originally anticipated).

If so, we'll probably apply in the next few weeks - that's great. Just need to make sure we can get another Bank Statement within the 28 day window, including my wife's July pay.

That would only be an issue if you wanted to apply 28 days before June 24th and were using the Super Priority service.

You have already given yourselves an extra 2-3 months leeway to apply for ILR by waiting until July/August to apply, so it’s nothing to worry about.

Ah perfect!

One final Q: We only have an electronically signed version of our tenancy agreement(s), which I can print/scan for the application.

Is this enough? Last time around we obtained a signed letter from our landlord, but not sure if this is still required.
