Clarification on # of Days allowed outside of the UK
« on: August 23, 2021, 01:19:04 PM »
I'm hoping someone can clarify the # of days allowed outside of the UK for spouse visa renewal and ILR.  I've searched the gov.uk website and haven't found this information.

I'm currently on my initial spouse visa which was granted in June 2019.  We will apply for renewal in early 2022.

My elderly parents are starting to need more assistance.  I want to help them without putting my renewal or ILR in jeopardy.

Thanks very much.

There is no limit for ILR, the emphasis is more on the couple living together, so you're going to want to limit the time you are apart from your spouse. There is however a limit on the days out of the country for citizenship and it sounds like it would be a good idea for you to go for it as soon as you can so that you are freer to spend as much time with your parents as you would like to.

To be eligible, you should not have:

spent more than 270 days outside the UK during the 3 years before your application
spent more than 90 days outside the UK in the last 12 months

Thanks so much.  Sounds like it won't be an issue for ILR.

I'll have to balance the citizenship requirement with what makes sense with my parents.

I keep a spreadsheet of my trips outside of the UK, including whether my husband was with me and if not where he was.  I figure it's good to have the documentation, even though I may never need it.

Thanks again.
