Next steps

Hiya!

Just some questions as I want to make sure on this. Came on fiancé visa and this is my second FLR (M) ends next May of 2022 and I would have been living in the UK for a bit over 5 years and married to a British citizen. Is my step dual citizenship that I can apply for? I am a US citizen so that would make sense? Would you recommend all three books to study for life in the UK test? Thanks for any help :)

Your next step is indefinite leave to remain, (ILR) form SET(M) After that it's citizenship. As you're married to a UKC, you can apply for citizenship as soon as you have your ILR BRP.

Use the official book then do as many online practice tests as it takes for you to pass comfortably every time.  :)

Not as long as you continue to live in the UK. If you leave for more than 2 years it does and you can't keep it going by visiting, you would have to come back to live.

It's definitely worth getting citizenship though, plans change and we have many members going through the whole thing for the second time because they didn't bother when they initially had the chance.

It would, yes. But after your second FLR, there are no more IHS fees to pay so there is that.
It's not cheap but it's not going to get any cheaper either so putting it off is not a good idea for that reason and also because it's just easier to apply when you still have the momentum!

ILR is currently £2,389 (but there's no extra IHS surcharge to pay).

Citizenship is currently £1,330.

It's frustrating that you have to pay for both, but unfortunately one of the requirements for UK citizenship is that you must first hold ILR. If you are married to a UK citizen, you only actually need to show the last 3 years of UK residency though, rather than the normal 5 years for those not married to UK citizens.

As long as you meet all the other citizenship requirements, you can apply as soon as you receive your ILR BRP :).

18. A person may resume their residence in the UK provided the Immigration Officer is satisfied that the person concerned:

    (i) had indefinite leave to enter or remain in the United Kingdom when he last left; and
    (ii) has not been away from the United Kingdom for more than 2 years; and
    (iii) did not receive assistance from public funds towards the cost of leaving the United Kingdom; and
    (iv) now seeks admission for the purpose of settlement.
