US Expat needs advice on UK 2019/2020 taxes
« on: October 18, 2021, 10:12:51 PM »
Hi everyone,

Just a great group and so lucky I found it.  Thanks in advance for any feedback!

I am hoping that there might be a US expat in the UK that could help me out with a situation I find myself in at the moment.

I moved to the UK in Jan 2020 and only had only lived here for 3 months before their 2019/2020 tax year closed. I did not file a UK tax return for that year as I got a letter from the UK HRMC indicating I had already paid too much in taxes and got a small refund (hurray!).

Well, my flashforward to today and my previous employer is helping with 2019 US expat taxes in Germany and asked for my 2019/2020 UK tax return to help claiming a credit on my US taxes...or I am going to owe appx $14K to the IRS.

Is it still possible to file a 2019/2020 UK tax return and any recommendation on anyone who can assist? Such a learning curve over here!

No it’s not too late to file 19/20. You can do it all through your government gateway account. Or give those friendly folks at HMRC a ring on their Self Assessment helpline (0300 200 3310, if I remember rightly?).

Here in the UK, you only file a Self Assessment tax return if you meet the criteria: for example: self-employed, certain non-employment income, very high income, need to pay additional taxes not covered through PAYE, like HICBC, Capital gains, etc…

You don’t have to file an SATR in order to avoid double taxation, if that’s your only ‘need’ for filing an SATR.

This year (20/21), I need to file an SATR for the first time to cover some Capital gains from some US investments I’ve cashed out. They’ve also sent me a notice to file for (19/20) but I don’t meet any SATR criteria, so need to call them to get them to withdraw the notice . But I digress…

You wouldn’t pay any penalties if you file by the deadline they send you (3 months from when notice to file is issued), but you would owe interest if you owed any tax.
