Military Visa - What happens if spouse leaves the RAF?
« on: May 12, 2022, 10:03:39 PM »
Hi everyone!

I was issued a spouse visa that was valid for 5 years since my husband is in the forces. My BRP says it is valid until 29-05-2024. My husband is in his last two years now and going through the resettlement process, starting to go to job fairs and everything. What happens to my visa if he leaves the RAF early? Is it still valid until 29-05-2024?

Thanks in advance!

If I'm reading this correctly, if he left within 2 years of your application date, you would still be eligible to apply for ILR.

.Eligibility
Your partner and children may be eligible if you either:

have been discharged in the past 2 years
are currently in the UK armed forces and have at least 5 years service
You must either be:

applying to settle in the UK
already settled, or a British citizen

Yes, that’s what I found out as well.

I think you will be able to continue living in the UK on your current visa, and as long as you qualify for it within 2 years of the date he leaves, you should be able to apply for ILR in 2024.

I'm so sorry for the delay in responding, life has been going absolutely crazy recently and I honestly forgot I'd already posted and asked this.

Thank you very much for the responses! It looks like we should be OK as he won't be leaving until we're within two years of applying for ILR. It's a little confusing because I can't find any information confirming I'm on a military spouse visa as opposed to a normal spouse visa except for the fact that the BRP dates are valid for 5 years. I've just gone through all of my old paperwork and emails and there's no mention.
