Fiancé Visa help

Hi, thankyou for reading my post. this forum is amazing!
I am currently in the process of a fiancé visa with my partner. I am the uk sponsor, my partner is the usa applicant.
I have a few questions that we seem to be unable to get any answers to. My partner contacted the visa help line, but they were not really able to give any sort of answer. It us a shame as my partner paid $60 for the privilege.
Ok so when we decided to apply it seemed that there was only one visa , but it covered 2 different types of visa. being fiance, spose and unmarried partner. so my partner chose this one, filled it in. it then said to give proof of being an unmarried partner. so we clarified this with the visa help line. the guy on the phone said, it was the right visa as it covered all 3. my partner paid for the visa and then it gave a bit more information about what was needed , a more indepth check list. everything seemed fine, but there is a still a part that wants us to proof we are unmarried partners. So it didnt seem right. We are not unmarried partners, we have never lived with each other. It would be impossible to do so. as we are in different countries. so my partner this time emailed the visa help line asking to clarify again, but they simply said they could not deal with personal questions relating to the visa. No i have since read on here that actually, if you say your single when making the application it then gives the option for a fiance visa. is this correct? or have they changed the visa and combined 3 on to the same application form? the visa he has paid for is listed as Appendix FM Partner, but on the paper it says Apply to enter the UK as a partner. if this is the wrong visa , then i guess we need to cancel it and chose the right one?

secondly, evidence. the photos and correspondence.  do i email my documents to my partner in usa and he uploads them on to the application? or am i meant to send the documents to him via post? do we upload the photos separately? or do we combine them all on to a paint document? so that it is one upload? the messages between us, again do we upload them separately by what they are and date? or do we make a sort of timeline combining them on a paint document. does he then have to print this out. or it is just uploaded as it is to the application form?

we have taken ss from facebook of posts witch shows us together , it also shows where we are in the location. they  span the 8 months we have met in person. over 3 different trips. i assume they only want correspondence  between the dates he wasnt here?  most of our correspondence was via  facebook messenger. there is also discord. is there a need to include both platforms if the dates are more or less the same time? . i was going to grab about 2 -3 lots of entries per week , a lot of them also show we were on video call for hours at a time, is this ok or do they need to see more text between us? all are date stamped.  thankyou for your time reading my post , any help would be appreciated.

Yes, it sounds like you've applied for the wrong visa. As long as he hasn't attended his biometrics appointment, you can cancel and will receive your application fee back.

 It's actually easier and cheaper if you go ahead and get married and apply directly for the spouse visa.  We always recommended this prior to Covid and now travel is opening up again it's become viable again.

How are you meeting the accommodation and financial requirements?

Ahh Noo, i kind of have a feeling it didn't sound right.  well im a full time carer to 4 disabled children, so i claim carers allowance, and i rent housing association housing.  Would the spose route mean i would have to go to America and get married? would i not have to apply for a visa to get there in the first place?  also thank you so very much for taking the time to respond.

Assuming that Covid travel rules permit, you can marry in the US with just an ESTA. But in your situation it might be better just going the fiancee route unless you have someone else who could look after your children.

With the fiancee visa, your partner must move to the UK and you must marry and apply for FLR within 6 months. During that time, no work is permitted and no use of the NHS without payment.

Although you would be exempt from the financial requirement, you would still need to prove adequate maintenance. You would also need permission from the housing association for your partner to live there and there must not be overcrowding.

Hi there, thank you for your reply. i have managed to sort out the accommodation, i have conformation from the housing authority that it would not be over crowded if he lived here and also that he has permission to do so. The adequate  maintenance  is also sorted, i understand that it is rent and council tax offset against funds.  i managed to get all the documents together needed for the sponsor. and had written the sponsor letter.   am i right in thinking that the  family visa was the right one, but that he should have said he was single in the beginning instead of listing me as his partner. i think the confusion is that in America i probably would have been classed as his partner as we are engaged. but in the uk you are single unless you are married.  so  i guess he needs to cancel the application, chose it again and this time be aware of what he should do in the beginning? will it then state fiancé visa at that point? luckily he has not attended a biometrics appointment yet.

Click through applying from outside of the UK. Yes, you're single if you are not married. You are not unmarried partners as you have to have proof of living together for 2 full years to apply under that category so you do need to cancel.
