When to Apply for IRL

Hi,

I'm coming up on five years with a spousal visa. Though normally this would have been time to apply for ILR, because of COVID, my current visa lasts until 31/05/2023. Do I apply within 28 days of that date?

Hi Julie,

Take the date you landed in the UK.  Add 5 years.  You can apply 28 days before that date.

So we landed  17th August 2017
Add 5 years =  17th  August 2022
We could apply 28 Days before that = 20th July 2022

We applied on the 22nd July 2022 .

Thanks for the reply. My 5 year date is 1 Feb, 2023. My biometric card says it's valid until 31-5-2023. Do I need to apply before 1 Feb or anytime in the window before 31-5?

Apologies to hijack this thread - I have a question about timings for application.

Just to clarify, is it correct that you can apply 28 days prior to the 5 year anniversary of first FLR(M) - i.e. any time on a fiancée visa does not count?

That’s correct.

If you arrived in the UK on a fiancé visa, then your 5-year count to ILR doesn’t start until the date your first FLR(M) is issued.
