IRS asking for 1042-S, 8805, 8288-A (Dual USC/UKC)
« on: March 17, 2023, 05:15:59 PM »
I e-filed my 2022 tax return, and just received a letter from the IRS asking for supporting material for my 1040SR line 25d.

They ask for W2, 1042-S, 8805, 8288-A, and "other US withholding documents".

(I'm not sure why they mention 1040SR, which is the large text version of the 1040 and only applicable to paper filing for those over 65. )

My line 25d is from W2 and 1099, so the W2 makes sense, but it should have been sent to them directly from my employer.

I have no idea how I'd fill in a 1042-S or the other forms, and it seems like the IRS thinks I'm not a US Citizen (which I am.)

Any thoughts or insights on this?

Jonathan

This happened to me about 3 years ago, but after I had filed a paper return. I had forgotten to include a copy of a 1099-R that had tax withholding that I claimed on line 25d.  In my case I ignored those other forms and sent in a copy of the missing 1099-R plus copies of our US passports with a note stating that we were US citizens so the resident alien forms they requested were not applicable.

Since you e-filed, maybe the amount of your  claimed withholdings did not match the actual forms that the IRS will have received from the providers or more likely they have not received them, or lost them.

I suggest you simply provide copies of the documents showing the withholdings plus proof that are not resident aliens.

Many thanks! I never sent the IRS our copies of the W2/1099 forms when we paper filed, and they don't get them when we e-file. I'm guessing that in previous years everything's matched on their side, so it wasn't a problem. But if they didn't get a 1099 or it didn't match for some reason, that would trigger this type of issue.

For sure that is what happened to me when I paper filed, although the withholding I listed on my return exactly matched that on the 1099. (The only US income that has withholding).  I figured they had not received their copy from the provider or had lost it, but I don't know why they pull that non-resident alien crap when we have been filing as US Citizens for 25 years.
