Married and have stepchildren now
« on: February 11, 2005, 11:16:25 AM »
Ok I have always filed single with no dependants and now I am wondering exactly what forms to file.  I moved to the UK in OCT of 2004 and have not worked here yet.  I am now married to a UK citizen and she has 3 children that are now my step children.  I have not contributed to support them yet.  So how do I file?  Thanks in advance for your help.

Assuming your wide and step children are not green card holders or US citizens, you will file as "married filing separate". You cannot claim the children as your dependents.

Ok I plan on filing with a 1040a and that is simple enough.   Now my only problem is I read somewhere on the IRS website that NRA is not acceptable but reading the instructions for the w-7 to apply for ITIN it doesn't look like she really falls under any of the categories.  She is not filing a US tax return.  I don't plan on claiming any dependants.  I just need to know if I actually need the w-7.

This is what I have found

e. Spouse of U.S. citizen/resident alien.
This category includes:
● A nonresident alien husband or wife who is
not filing a U.S. tax return (including a joint
return) and who is not eligible to obtain an
SSN but who, as a spouse, can be claimed
as an exemption.
● A nonresident alien electing to file a U.S.
tax return jointly with a spouse who is a U.S.
citizen or resident.

So I am assuming that I don't need the w-7 however do I just put her name in at the top when its asking for the spouse information and leave the ITIN blank or do I just not put her on it at all?

Thank you again

I was confused about that as well when I first filed as married (last year).  If you're filing separately, your wife won't need an ITIN and it's perfectly acceptable to write "NRA" where it asks for her SSN.  The only time you'll need the W-7 (and thus, the ITIN) is when/if you file jointly.

I think the IRS means that it's unacceptable to write NRA when your spouse is eligible for/requires an ITIN to file.
