UP vs Fiancee Visa
« on: October 01, 2005, 10:12:28 PM »
I was wondering if there is any benefit to getting a Fiancee visa over an unmarried partner one.

My gf and I won't be moving for another year.  By that time the civil partnership act will be well under way and she should be able to get a fiancee (or whatever they will end up calling it) visa to come over with me.  But it seems it makes much more sense to go the UP route, because she would get her FLR and be able to work immediately and not have to file anything else until the 2 years were up.  But is there any advantage to the fiancee route that I am perhaps not aware of?

For the unmarried partner visa, do you get FLR/FLE regardless of how long you have been together?  Or is like the marriage visa, where it's possible to get ILR/ILE if you have been together long enough?

Thanks!

You can go straight for the ILE concession if you meet the rules...

I'm sorry, I couldn't find anything in that thread regarding getting ILE as a UP.

An unmarried partner who has completed a period of 4 years as the unmarried partner of a British citizen or person settled here, having lived together abroad with that person throughout that 4 year period, and arrives in possession of an entry clearance endorsed "SETTLEMENT/TO JOIN PARTNER [partners surname and first initial] should be granted indefinite leave to enter. [Paragraph 295B of HC395 as amended by HC 538]

Thanks, Garry.  I was pretty sure I had read that in the past but when I looked on the UK Visas site, I couldn't find anything about it.

But just bear in mind that everyone's expecting a big levelling down after the CPB activates and they have had time to mull over what to do next...

Maybe by summer of 06...
