JUST MARRIED!

Hi, I am a U. S. citizen who just married the man of her dreams, he is a UK resident and we are currently here in the US. we are getting ready to file the I-130 and the I-465 and the advance parole so his case doesnt get abandoned. What we were wondering is: what is the next step once we cross over into UK soil as a married couple? Do we have to file any visa's for me to come over? What about visas for her and putting her in school, will I be able to do that right away after getting there? and can i stay past our six months? This is an abundance of questions I know and apologize ahead of time but im stressing hard now since were trying to decide what to do in a foreign country.

If you wait till the Uk wakes up there are plenty of people who will be able to answer your questions.

Congrats! If you are wanting to move to the UK you need to get a visa before you come over.

hopefully this wont sound stupid.. or redundant.. but when i visited the UK before i was on a tourist visa i believe? since i am still in the US we are getting ready to file the i-130 and the 1-485 concurrently, when i go and submit a name change on the passport are either of those 2 papers up there i just named the spousal  visa and is that going to get me and my daughter into the UK and do i wait and do a settlement visa or indefinate leave to remain once i am actually in the uK?

If you are intending to live in the UK you have to first file for your spousal visa. The form can be found on the link HG provided. You will be unable to settle in the UK without it

The I-130 and I-485 are only for people who want to get a green card to live and work in the US.   If you are going to live in the UK then you need to get a spousal visa and your daughter needs a dependent one.  You have to do this before entering the UK or you will be sent back to the US.  You also need to prove that you can take your daughter out of the country to live with you if that is an issue.

MAKE SURE YOU GET A SPOUSAL VISA BEFORE COMING TO THE UK!!  They say that you can visit the UK for up to 6 months without a visa........it's a LIE!!  I tried this, and they detained me 8 hours without any food (I got real sick) and sent me straight back.  I was out the $750 for the plane ticket and the gas for the 6 hour drive to and from the airport in the US.  This happened to me over Valentine's weekend, and my sweetie hopped on a plane a couple hours after they sent me back and we had a romantic weekend in Chicago.  Oh....getting off the point....sorry.  So make sure you have a spousal visa!  Good luck! :)

aw surfergurl, that is just about the saddest immigration story I have ever heard!  :\\\'( :\\\'(  I can only imagine your excitement and then having it turn into a nightmare 8 hours later. That was great of your sweetie to hop on a plane and spend Valentine's weekend with you. Thanks for sharing, lots of people will learn from this!

It's not a lie -- you can visit the UK for up to six months, but if you're entering as a spouse, you'll need a spousal visa.  I'm assuming you were "visiting" as a spouse, but that threw up a lot of red flags for the immigration officials....sounds like they weren't convinced that you were planning on leaving the UK to obtain your spousal visa.

If there are no complications, an advisor can usually spring a visiting spouse from detention in about 30 minutes.  Were you detained under Section 10?  Or were there complications that obviated an emergency appeal?

If you were wrongly sent back, the airfare can be recovered in court.  That's for spouses, and note this does NOT hold true for bfs and gfs....

Sorry, been gone for a while.  I did try to go over to the UK as a friend.  We weren't married at the time.  We were still new to dating.  So I just told them he was my friend.  I was sent back with a couple other normal looking people.  I don't know what to say, just be careful!
