Visiting AFTER LLR
« on: December 19, 2005, 02:59:31 PM »
We have decided to move back to the US and my husband's US immigrant and non-immigrant  paperwork is already working its way through the system.  I have been back in the US for the past couple of weeks and plan to return to the UK to visit over the holidays.  I have been in and out of the UK since I left- literally every 6 weeks since March (a few questions and raised eyebrows each time I returned, but no serious problems re-entering the UK).  Does anyone know how I go about letting the IND know I am no longer using this visa?  Do I need to let them know?  Will I have trouble visiting the UK with my husband- or does the fact that I actually have a valid visa show that I could be immigrating if I want, but I'm choosing not to because I'm back in the US?  I also plan to fly into the UK to attend my husband's K-3 interview sometime hopefully in February.  Any suggestions will be appreciated.  BTW, I am terribly homesick for Englanld- it's a gorgeous country filled with wonderful people, however major family issues have forced us to return.

If anyone has left the US with a valid visa in their passport- can you let me know if you contacted the IND to let them know you were leaving- or did you just go?  I have tried to look on the IND website but there is no information at all about that.  I also looked on the British embassy website but again found no information.

I don't know what to do about this to be honest. You've got a valid visa which gives you the right to enter as many times as you want, so I'd think there wouldn't be a problem. Perhaps I'm not understanding what your situation is though. If you've got a valid visa to live and stay in the UK, but are in the US right now and going back and forth while your husband immigrates, then I can't see any problem with that whatsoever. As far as letting them know you aren't going to use it anymore, wouldn't you just let it expire, and do nothing about it? That's how I thought that worked. I had a FLR visa, and we immigrated to the US before my renewal time was up. My visa is no longer valid as too much time has passed, but we never told anyone about it. Seems like we would just reapply and do the whole system over again if I wanted to go back to the UK.
I'm done moving. Unrepatriated back to the UK, here for good!

I think Marlespo is right, you don't need to do anything.

Also, just so you know ahead of time.  When I went with DH for his K-1 interview in London, noone except the person applying was alowing in the visa area.  I wasn't even alowed past security.  I had to go back to the hotel and wait, and then I waited in the park next to the embassy when he went back to pick up his passport in the afternoon.
Dream a dream of England .......... Some day

Thanks- just didn't want to NOT do something if I was supposed to inform the IND of change of circumstance or something.  I'm no longer a resident of the UK and am now officially living and (soon) working in the US again.  Any trips to the UK in the near future are to just visit my husband while awaiting his immigrant visa.  What a difference a year makes.
Beccaboo- do you mind me asking how long ago that was?  Perhaps it's different for a K-3 and/or CR-1 interview as I've known several others who have gone for those interviews in London and they've attended with their spouses.............
