Going to the US to bring my wife back to Scotland
« on: April 13, 2006, 12:41:22 PM »
Hello,

Has anyone here been through getting married in the US under the visa waiver program, then wanting to go and live in the UK?

im from scotland and i came back home myself after our wedding in March as she is still studying, but i plan to go back out  at the end of april for a few weeks as she is graduating,  then we plan to get clearance for her to come back to the UK with me.

will customs in america have a problem with the fact we are now married and also that im back so soon after my last visit?

i have found customs pleasant before, but i just wondered if they would be suspicious as to why im not with my wife or why we married under the visa waiver.
id hope telling them that she's moving to scotland would justify that.

also, iv got proof of most things, but if anyone has any advice on our interview with the british embassy it would be greatly appreciated.

cheers!

You arent doing anything wrong by marrying under the visa waiver program because you are not staying to settle in the US.

I was a bit confused by your post, is your then-wife going with you back to Scotland at the same time? Either way she will need a spousal visa before entering the UK once the two of you have married. I hope I have helped. I came to the UK as a fiancee so as for what to take to the consulate to get her visa I cant be of much help.

US immigration may question you, but if you can bring whatever you can to prove you are not settling then everything should be fine. Good luck!

Thanks for the reply,

She will be coming back with me to Scotland, we just want to spend some time in the US before we leave for good,  i just wanted to double check we were going by the rules.

im sure we have anything we need for the embassy appointment, so fingers crossed it will go smoothly.

Thanks again!

My husband (also from Scotland) and I got married in the US while he was on the visa waiver program.  He's back in Scotland, but I did get my visa to move there to settle.  I don't see a problem if you went back to visit for a couple of weeks...I think the visa waiver program entiles you to stay for 30 days?  It could be more, but I think they changed it to 30 days.
Good luck :)
