Is 16 months too big of a gap for fiance visa?

Ok so it looks as though my fiance will not be able to come to the states anytime soon. We had planed that he come here for 2 weeks and then I apply for my visa. We have not seen each other in about a year and 4 months because he is in the process of buying a new business and he has been having trouble with his current business and is unable to leave. I am not allowed to come to the UK without a visa (well I was never told I was not allowed but I was told that I should get a visa if I want to come back cause it may make it easier) so thats what keeping me from going to see him. Anyway my question is could I apply for my visa even though we have not seen each other in over a year? We talk more than once daily on the phone (so we have plenty of phone records) we have loads of emails, letters and cards from the begining of our relationship up to date. Statements from family memebers saying that we have all met eachother and that we are planning to marry. I would like to apply but I am not sure if the time gap will be a problem. Got any advice?

I applied for my fiance visa with a 10 month gap between my last visit and when I applied for the visa. As long as you can show proof of ongoing contact (email, IM, phone), I don't think it makes a difference.

What they are looking for is proof of your relationship.  As long as you have that, you should be fine.  You could always call the helpline to find out for sure.

Plus, I believe they want to be certain that you have met in person, and you have and have proof of it, so you should be fine!

Why can't you enter the UK without a visa? I thought all you needed was a passport... :-\\\\

Why can't you enter the UK without a visa? I thought all you needed was a passport... :-\\\\

Well the first time I tried to visit  I was denied entry because I had a 6 month return ticket and didn't bring much money because I was visiting my fiance and he would be taking care of all my needs. I don't work here in the states so I didn't have a job to come back to so they thought I was going to try and overstay in the UK so I was told next time I want to come back to get a visitors visa but both times I applied for a visitors I was denied based on that facts that I didn't have job, property or children in the states to come back to. So thats why I cant go over there with just my passport (sorry to ramble on  :P) I have loads of proof of contact (cards, emails, phone records, phone card receipts etc. ) to show that we have been having a relationship for 2+ years I am just afraid they are going to deny me a fiance visa so I am covering all my bases.

0o0o I see. Why not make the visit shorter? I'm sure if you go for a week or 2 they'll be less likely to think you'll stay illegally. What about getting a job...for 6 months and then tryin to go over for a visit? I hope things turn out for you...it's really hard going so long.

I have been advised my immigration and my immigration solisitor not to try and enter again without a visa in case I do get turned away again it would look worse on my imigration record. It is really hard to go so long without seeing eachother. Now I see why so many long distance relationships dont work :(

Oh...hmm...well what does your immigratin solisitor say about you ever seeing eachother again? You've already been turned away with a passport and a visa...so what's the solution to this situation? Would it help if you got a job??

My solicitor does not think that getting a job would help. She says that they (they meaning immigration) know that we are a couple now and thats is against us. When I went over and was stopped at passport control. when asked who I was visiting I said friends then they interviewed by boyfriend and he said we were together so they said I showed deception. We have meta and I have plenty of proof that we are and have been together so I am hoping that it will be enough. I just want to get to him so we can start planning our wedding. :)

We though about me flying to france but I was scared that I would still be stopped and questioned because I have the crossed out denied stamp in my passport. I'm a scardy cat!  :P
