Topic: What's the up to date procedure for FLR?  (Read 4051 times)

What's the up to date procedure for FLR?

Someone was asking me today, and I have honestly drawn a blank as to what we had to produce for the Home Office when we applied for mine. It was like a lifetime ago, and I know things have changed a bit. Price has gone up alot for one thing.

Can someone give me the scoop?

How long after the marriage ceremony do you have to apply, or do you apply a month before the fiance visa expires?

What documentation do you need to show, passport, marriage license, photographs, etc?

And finally, what about leaving the country for the honeymoon, while still on the fiance visa? Is that ok? I remember I had to fly to the states BEFORE the wedding on emergency family business, but what about after the marriage takes place?

I used to know all this stuff,,lol.

You should really apply for the spousal visas as soon as possible after you marry.  Complete the form and bring the documents as listed on the back - basically the same docs as for the fiancee visa but with the marriage certificate.

Leaving the UK after the marriage but before you change status is an absolute no-no.

The reason I ask, is that I seem to remember that they wouldn't consider processing your FLR if you sent it to them, before the last 30 days of your fiance visa. I want to make sure I am giving the right information, lol.

You're thinking of the ILR date restriction - you can only apply for ILR 28 days before the expiration of your FLR. I got my FLR 13 days after I got married (4 months before my fiance visa was set to expire).

Oops! I was totally unaware of this. My partner and I went to Malta for our honeymoon for 5 days after our civil partner registry and I have not switched from proposed CP visa to FLR. The reason why I hadn't switched it before we left is because the 500 GBP price tag attached to it. I'm supposed to go to Home Office at the end of the month. I hope this doesn't cause any major problems with the HO.  :-\\\\

Victoria is way correct. 

Based upon what you've written you are technically an illegal entrant.  That's based upon the rule of 'deception by silence' which is spelled out in the IDI's.  There's no getting around it either.

They probably will not do anything about it, but it's good to know how the rules work and that if they wanted to bust heads, they could.  Not a big deal because nowadays they have bigger fish to fry than a simple decption by silence...

hmm makes me think of when I came through Heathrow with my fiance visa,the IO looked at my visa and asked where my husband was... I told her my fiance was downstairs waiting for me ..perhaps it was a trick question ???

Tebs was asking for me.  We booked our honeymoon after the wedding, but haven't had time inbetween the wedding and honeymoon to apply for the FLR.  We didn't realise that it took at about 4 weeks (and possibly more) to apply for.  We honestly don't have time now to get the FLR.  Will this cause issues when we apply for the FLR in about 1.5 weeks?  My financee visa doesn't expire until July.

Just curious why this is, as you've got six months before the fiance visa expires. If you get married well before the six months is up, why wouldn't the unexpired fiance visa give you entry clearance? (I was able to apply for my FLR in person and get it the same day.)

You would be trying to re-enter the UK as a fiancé but you'd actually be a spouse.

I know, but couldn't you just tell the i.o. that you planed to get your FLR before the fiancee visa expired?

Just as I entired the UK as a visitor when I was engaged, and told the i.o. that I would be returning to the US to get my fiance visa and had no problem entering.

It would be less risky if you had the FLR, of course.

It would be less risky if you had the FLR, of course.

But technically, you're not required to have a fiancé visa until you enter the UK to actually get married.  So it would not be the same as already being married and (re-)entering the UK on a fiancé visa.

StuzMrs is right...you could really face problems on entry if you are clearly back from your honeymoon and didn't change your status.

I would say to change before you go - you may have to fork out the £500 for the same day service.
