Is an ILR on HSMP different than a non-HSMP ILR?
« on: May 30, 2006, 11:23:19 AM »
We're here on the HSMP; we have the normal HSMP restrictions like no access to public funds, no Child Benefit, etc.

When we apply for ILR, will there be any new limits?  Or just another year of HSMP?

I don't think I'm explaining myself well, I'm really sorry.  We want to make certain we aren't going to have a new set of restrictions with an HSMP ILR, like we can't leave the UK during those 12 months, or something (I'm aware of the minimum number of days in the UK during ILR period).

Thanks again.

ILR is ILR.  No restrictions.

Thanks very much.  But we would still be on the HSMP, so we'd have all those restrictions, correct?  Just like we have these restrictions with our FLR which is totally dependent on the HSMP?

Nope...ILR is the same for us all...I'll no longer be tied to my job, a spouse would no longer (have to) be tied to their hubby or wife, etc.  You will no longer be on HSMP at that point...

One more question:  is June 2006 the official start date for the new guidelines which apply to HSMPers wrt to ILR?  We will have to do an additional year on FLR...instead of 4 years to get to ILR, it is 5 years (dammit)?  And no one is grandfathered?

Thanks again!!

The official start date was 3rd April 2006.  Sucks, I know.

Thanks, April it is then.  Yes, it does suck very much.  But the UK government is ever consistent in this (limiting immigrants) direction, that much can be said!

Is there any hope, what with letters to MPs and protesting this?  Or is it thought to be a done deal and no grandfathering, exceptions made?

It really is a done deal.  I know ancestry visa holders are especially angry about it, but I don't think there is anything that can be done.
