Topic: Do you have to apply from home country for a fiance visa?????  (Read 1978 times)

Is it REALLY compulsory?

I'm Scottish and my fiance is American.  He's been here living with me for 5 months on a passport.  We are seriously worrying about whether he has to go back to the states to apply for a fiance visa. This is a nightmare. !!  :-\\\\

Whats the script?

I am afraid he does.  He can't get a fiance visa from anywhere other than the British Consulate in the US (or any other country in which he has legal residency).

He can't apply on line.  If he were to make an online application pretending he were in the US he would be breaking the law.

There is no way around it.

What if he applied in home country and then came back here to visit while the visa was being processed?

that would be impossible because he would have to submit his passport with the application...but it doesn't take very long to process at all.  If he flies straight to his nearest consulate and applies in person, he'll have the visa the same day.  If he applies by post, it'll only take 1-2 weeks to get the visa.
Now a triple citizen!

Student visa 9/06-->Int'l Grad Scheme 1/08-->FLR(M) 7/08-->ILR 6/10-->British citizenship 12/12

And he needs to do it now, being an over-stayer is not a good idea and will not help matters AT ALL.

he can return as soon as he has his fiance visa.

Without his visa?  He could technically leave and come back for another six months but he'd run the high risk of being caught.  He could fly home to the US, go to the consulate and back on the plane the next day.  Getting a visa isn't a big deal, even though most people here (me included) have freaked about it.

If he is at 5 months, you really need to consider getting this taken care of.  If he gets caught overstaying his visa, you are going to have a lot more headaches then you want.  I would do your best to figure out a way to get to Chicago, New York or LA and get the Fiancee visa taken care of.  Like people say, if you apply in person, the turnaround is the same day 90% of cases.  Believe this is something you want to take care of and not avoid or put off any longer.

If he applies on line I believe there is an appointment system, but one of the girls who has been through this will have more info (we are not allowed to deal with on line applications).   You don't have to go with him.

The website (http://www.visa4uk.fco.gov.uk/) will allow you to submit your resume ahead of time online, pay your fees via credit card and schedule your appointment in Chicago, all from the comfort of your living room!
