Possibly moving back

Hello all,
I need some advice....I retained a spousal visa to move to the UK in August 2004, since then we have moved back to USA, DH has his green card etc., and his mother has fallen critically ill, so he wants to move BACK to UK.....
Problem with this is...my visa expires in August (next month) and I'm not up really for the whole shuffle back etc.
Is there an easier route to renewing this visa, or do we in fact have to start from scratch again to be able to move back?

If you want to keep the same visa, you'll need to move back before it expires.  If you've been in the US for a long time or can't prove that you and DH have been living together for the duration of your spousal visa, you may have difficulty in applying for ILR.  In order to have more time to prove that you've been together for the duration of your marriage for the purposes of obtaining your ILR, you can apply for an extension of your FLR (not sure about the actual procedure for that), but I'm not sure if that can be done from the US.   ???

Otherwise, if you want to travel back to the UK after your current visa expires, you'll need to apply for a new one, meeting financial/accommodation/relationship criteria you had to meet for your first spousal visa.

Your choices seem to be a fresh application from the US or coming in on the current visa and then extending when you get to the UK.  Doing it all from the US will be much, much easier.

You won't be able to get ILR from within the UK if you have been out of the UK for a long period of time...I would say that over three months would be dodgy.

Yep lola that's sort of what I figured...but wanted to be for sure, I had asked someone else, and they directed me to you guys to get my advice from, I guess when/if it does happen, we'll have to really plan for it and I might have to stay back here for a bit while things are established there again....that's really all that makes sense, because if we were to apply to extend, we'd have no proof of anything more than residency in the USA for the past 16 months.
