DCF or keep CR1 to US

Hiya!

We started my uk hubby's 130 last year and it got approved in december, but I received my UK settlement visa round the same time, so I could spend the rest of the year with him in uk while he finished school. Now that he's done, we're proceeding with his CR1, since we are heading back to US for better job offers in the next year.

Questions:
1. Since we started the 130 from the US do I continue with that or start DCF at the london embassy? we'll have been married 2 years at time of applying.

2. When we leave, does my uk settlement visa cancel out, so that if we ever come back to the uk i'd have to apply for spousal visa all over again? Since I may only be here a year at most... How long do I have to be out of uk before it ends my visa? I imagined from somewhere it was 3 months? and would I just have to come back for a visit to keep my visa active??

Well, if your I-130 was only approved in December 2005 then it's still awaiting further instruction at the NVC and will remain there until a year has passed unless you contact the NVC to continue the process.

The amount of time you've been married does not count at this stage but at the time your husband enters the States with his visa. What with the length of time being over two years then he will be eligible to receive the 10 year green card with no conditions to move.
